WHEREAS, in February 2019, the United States Department of Health and Human Services (HHS), Health Resources and Services Administration (HRSA), announced a new initiative, "Ending the HIV Epidemic: A Plan for America-Ryan White HIV/AIDS Program Parts A and B". This ten (10) year initiative beginning in 2020 seeks to achieve the important goal of reducing new HIV infections in the United States to less than 3,000 per year by 2030; and
WHEREAS, the first phase of the initiative will focus on forty-eight (48) counties, Washington, D.C., San Juan, Puerto Rico, and seven (7) states that have a substantial rural HIV burden. By focusing on these jurisdictions in the first phase of the initiative, HHS plans to reduce new HIV infections by seventy-five percent (75%) within five (5) years. Across the United States, the initiative will promote and implement the Four Pillars to substantially reduce HIV transmissions: (1) Diagnose (as early as possible); (2) Treat (rapidly and effectively to reach sustained viral suppression); (3) Prevent (transmission using proven interventions, including pre-exposure prophylaxis and syringe services programs); and (4) Respond (quickly to potential HIV outbreaks to get needed prevention and treatment services to people who need them); and
WHEREAS, on August 13, 2019, HRSA, through Authorization (Legislation/Regulation) Public Health Service Act, Section 311(c) (42 USC 243(c)) and Title XXVI (42 U.S.C. ?? 300ff-11 et seq.) announced Notice of Funding opportunity for its program titled "Ending the HIV Epidemic: A Plan for America - Ryan White HIV/AIDS Program Parts A and B"; and
WHEREAS, the City's Department of Health and Community Wellness (hereinafter, "DHCW"), Ryan White Unit, desires to provide "Ending the HIV Epidemic: A Plan for America-Ryan White HIV/AIDS Program Parts A and B", and participate in the initiative and first phase that will promote and implement Pillars Two and Four to substantially reduce HIV transmissions: (2) Treat (rapidly and effectively to reach sustained viral suppression), and (4) Respond (quickly to potential HIV outbreaks to get needed prevention and treatment services to people who need them) to reduce new HIV infections by seventy-five percent (75%) within five (5) years; and
WHEREAS, on October 15, 2019, on behalf of the City of Newark (hereinafter, "City"), the Director of the DHCW submitted an application to the HHS, HRSA, 5600 Fishers Lane, Rockville, Maryland 20857, requesting funding in the amount of Twenty-One Million Eight Hundred Fourteen Thousand One Dollars and Zero Cents ($21,814,001.00) budgeted over a five (5) year period from FY2020 through FY2024, for the provision of "Ending the HIV Epidemic: A Plan for America-Ryan White HIV/AIDS Program Parts A and B", health, social and related services to HIV/AIDS-infected individuals and families in the City of Newark and the Newark EMA and support the national goal of reducing new HIV infections to less than 3,000 per year by 2030 (a copy of the Five Year Budget is attached); and
WHEREAS, Resolution 7R5-a adopted on July 22, 2020, erroneously authorized the City's application requesting grant funds in the amount of Four Million Dollars and Zero Cents ($4,000,000.00); and
WHEREAS, Resolution 7R5-a(S) adopted on June 22, 2021, amended the City's application to reflect the corrected grant funds request in the amount of Twenty-One Million Eight Hundred Fourteen Thousand One Dollars and Zero Cents ($21,814,001.00), budgeted over a five (5) year period, from FY 2020 through FY 2024; and
WHEREAS, HRSA will notify the City each year of the amount of the grant award for each fiscal year; and
WHEREAS, as a result of the City's October 15, 2019 grant application, (attached hereto), requesting funding in the amount of Twenty-One Million Eight Hundred Fourteen Thousand One Dollars and Zero Cents ($21,814,001.00), budgeted over a five (5) year period from FY 2020 through FY 2024. HRSA has notified the City of an FY2024 partial award in the amount of Nine Hundred Thirteen Thousand, Four Hundred Twenty-Eight Dollars and Zero Cents ($913,428.00), to provide "Ending the HIV Epidemic: A Plan for America-Ryan White HIV/AIDS Program Parts A and B", related services and participate in the initiative and first phase that will promote and implement Pillars Two and Four to substantially reduce new HIV infections by seventy-five percent (75%) within five (5) years and support the national goal of reducing new HIV infections to less than 3,000 per year by 2030, with no City funds required; and
WHEREAS, the DHCW desires to accept said partial grant funds in the amount of Nine Hundred Thirteen Thousand, Four Hundred Twenty-Eight Dollars and Zero Cents ($913,428.00); and
WHEREAS, the DHCW desires to expend the FY 2024 partial grant funds, through Request for Proposals, to provide "Ending the HIV Epidemic in Essex County - Ryan White Program Part A" services; and
WHEREAS, the Mayor of the City of Newark and the Director of the Department of Health and Community Wellness desire to accept additional funds as they may become available from HRSA under "Ending the HIV Epidemic: A Plan for America-Ryan White HIV/AIDS Program Parts A and B"; and
WHEREAS, the City's DHCW shall, upon receipt of additional funding, file an amending Resolution reflecting the final award amount of each Sub-Recipient, accompanied with a copy of the Notice to Proceed/Award Letter and Certification of Funds; and
WHEREAS, funding will be provided in the form of a cooperative agreement, which is an award instrument of financial assistance where substantial involvement is anticipated between HRSA and the recipient during performance of the contemplated project. The recipient is expected to collaborate with the HIV/AIDS Bureau (HAB) and its RWHAP recipients to achieve the expectations described in the program expectations section; and
WHEREAS, HRSA does not require the City to execute a grant agreement or cooperative agreement in order to accept the aforementioned grant award.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Health Community Wellness ("DHCW"), are authorized to accept the partial grant award for FY 2024 in the amount of Nine Hundred Thirteen Thousand, Four Hundred Twenty-Eight Dollars and Zero Cents ($913,428.00), from the United States Department of Health and Human Services, Health Resources and Services Administration ("HRSA") (a copy of the grant award is attached hereto and made a part hereof).
2. The Mayor of the City of Newark and/or his designee, the Director of the DHCW, are authorized to receive and expend the grant award, through Request for Proposals, to provide "Ending the HIV Epidemic: A Plan for America- Ryan White Program Parts A and B", related services and participate in the initiative and first phase that will promote and implement Pillars Two and Four to substantially reduce HIV transmissions: (2) Treat (rapidly and effectively to reach sustained viral suppression); and (4) Respond (quickly to potential HIV outbreaks to get needed prevention and treatment services to people who need them) to reduce new HIV infections by seventy-five percent (75%) within five (5) years to HIV/AIDS-infected individuals and families in the City of Newark and the Newark EMA and support the national goal of reducing new HIV infections to less than 3,000 per year by 2030, for the period commencing on March 1, 2024 and terminating on February 28, 2025 (a copy of the grant award is attached hereto and made a part hereof).
3. The Municipal Council ratifies the acceptance of this grant award from March 1, 2024, to the date of adoption of this authorizing Resolution.
4. The City's Department of Health and Community Wellness, shall file an Amending Resolution upon receipt of the additional funds, which shall state the contract amount for each Sub-Recipient and/or Vendor accompanied with the Notice to Proceed and the Certification of Funds.
5. The City's acceptance and expenditure of any additional FY2024 'Ending the HIV Epidemic: A Plan for America-Ryan White Program Parts A and B" grant funds from HRSA shall be subject to the approval of the Municipal Council by Resolution.
6. No municipal funds are required for receipt or acceptance of this grant award.
7. The Director of the Department of Health and Community Wellness shall file a fully executed copy of the grant application and the grant award letter in the Office of the City Clerk.
STATEMENT
This Resolution ratifies and authorizes the actions taken by the Director of the Department of Health and Community Wellness to accept and expend the FY 2024 partial grant funds through Request for Proposals, to provide Ending the HIV Epidemic in Essex County - Ryan White Program Part A services, in the amount of Nine Hundred Thirteen Thousand Four Hundred Twenty Eight Dollars and Zero Cents ($913,428.00), for the period commencing March 1, 2024, and terminating on February 28, 2025. No municipal funds are required for receipt or acceptance of this grant award.
