WHEREAS, the New Jersey "Clean Communities and Recycling Act" of 1981 created the Municipal Recycling Tonnage Grant Program, whereby municipalities could receive a grant for the amount of materials documented as being recycled during the previous calendar year; and
 
WHEREAS, in 1987, the New Jersey "Mandatory Source Separation and Recycling Act," specifically N.J.S.A. 13:1E-99.16, mandated that municipalities submit an annual Recycling Tonnage Report summarizing the amount of material recycled during the previous calendar year; and
 
WHEREAS, in 2008 the Director of Neighborhood and Recreational Services caused an annual Recycling Tonnage Report to be filed on behalf of the City of Newark with the New Jersey Department of Environmental Protection ("NJDEP") for calendar year 2007; and
 
WHEREAS, on or about November 4, 2009, the NJDEP awarded the City 2007 Recycling Tonnage Grant funds in the amount of $272,037.17 (see "Unallocated Grant Receipts" report attached hereto and made a part hereof); and
 
WHEREAS, the Director of Neighborhood and Recreational Services wishes to accept said 2007 Recycling Tonnage Grant funds; and
 
WHEREAS, no grant agreement is required in order to accept the 2007 Recycling Tonnage Grant funds; and
 
WHEREAS, no matching municipal funds are required for acceptance of the 2007 Recycling Tonnage Grant funds; and
 
WHEREAS, no commitment of City resources or staff are required for acceptance of the 2007 Recycling Tonnage Grant funds; and
 
WHEREAS, pursuant to the New Jersey "Recycling Enhancement Act," P.L. 2007, c. 311, all recycling tonnage grant monies received by a municipality must be expended only for its recycling program.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Director of Neighborhood and Recreational Services is hereby authorized to submit an annual Recycling Tonnage Report with the NJDEP for calendar year 2007.
 
2.      The Municipal Council hereby ratifies its authorization of this submission from the date of submission to the date of adoption of this authorizing resolution.
 
3.      The acceptance of the 2007 Recycling Tonnage Grant in the amount of $272,037.17 is hereby authorized and ratified.
 
4.      No municipal funds are required for receipt or acceptance of the 2007 Recycling Tonnage Grant funds.
 
5.      No commitment of City resources or staff are required for acceptance of the 2007 Recycling Tonnage Grant funds.
 
6.      All 2007 Recycling Tonnage Grant funds shall be expended only for the City's recycling program.
 
STATEMENT
 
This resolution ratifies and authorizes the actions taken by the Director of Neighborhood and Recreational Services to submit an annual Recycling Tonnage Report with the NJDEP for calendar year 2007 and furthermore ratifies and authorizes the acceptance of the 2007 Recycling Tonnage Grant in the amount of $272,037.17.  No municipal funds are required.
