Additional Information: 

This Resolution accepts a Grant in the amount of Three Million Three Hundred Twenty-Five Thousand Dollars and Zero Cents ($3,325,000.00) from the Triborough Bridge and Tunnel Authority ("TBTA") for mitigation activities.

WHEREAS, the Mayor of the City of Newark (the “City”) and the Municipal Council are dedicated to promoting a healthy urban forest within the City; and

 

WHEREAS, Triborough Bridge and Tunnel Authority, a public benefit corporation of the State of New York, 2 Broadway, New York, NY 10004 (“TBTA”), the New York State Department of Transportation (“NYSDOT”), and the New York City Department of Transportation (“NYCDOT”) (collectively the “Project Sponsors”), with the U.S. Federal Highway Administration (“FHWA”) as the lead federal agency, conducted an environmental assessment in accordance with the National Environmental Policy Act (“NEPA”) to analyze the potential impacts of implementing the Central Business District Tolling Program (“Program”); and

 

WHEREAS, a Mitigation Plan was prepared identifying the City as a community in need of place-based mitigation for (i) air filtration units in public schools near highways, (ii) improvements to parks and greenspace, and (iii) planting of roadside vegetation, pursuant to funding from the TBTA paid for by revenues from the Program; and

 

WHEREAS, the Final Mitigation Plan has been prepared and includes a plan for the use of Three Million Three Hundred Twenty-Five Thousand and Zero Cents ($3,325,000.00) (the “Newark Earmark”) for a transformative greening initiative focused on planting 1,000 new street trees and creating 1,000 tree pits on corridors near bus stops, schools, homes, and areas with high traffic to provide shade, cooling, and pollution filtration to be performed by the City of Newark in accordance with the Scope of Work, Budget and Schedule (the “Newark Roadside Vegetation Plan”); and

 

WHEREAS, the TBTA has awarded the City Three Million Three Hundred Twenty-Five Thousand and Zero Cents ($3,325,000.00) in Grant Funds as part of the Mitigation Plan for the Newark Roadside Vegetation Plan; and 

 

WHEREAS, TBTA and the City desire to enter into an Agreement in respect of the activities, work and services to be undertaken, performed and completed by the City in connection with the Subject Mitigation Project (collectively, the “Subject Mitigation Activities”).

                     

WHEREAS, the Office of Business Administrator on behalf of the City, desires to accept the Grant Funds in the amount of Three Million Three Hundred Twenty-Five Thousand and Zero Cents ($3,325,000.00) for the implementation of the Newark Roadside Vegetation Plan through the Office of Sustainability, Resilience, and Community Transformation; and

 

WHEREAS, TBTA and the City desire to enter into an Agreement (“Mitigation Activities Agreement”) with respect to the activities, work and services to be undertaken, performed and completed by the City (a copy of the Mitigation Activities Agreement is attached hereto and made a part hereof) ; and

 

WHEREAS, the City recognizes that the TBTA may amend the grant to reflect any time extension and/or increase or decrease of grant funds, as appropriate and which shall be subject to approval by the Municipal Council by Resolution; and

 

WHEREAS, the terms of this grant award may only be waived or amended by the parties duly authorized to execute the grant, subject to the approval of the Municipal Council by resolution; and

 

WHEREAS, no City funds are required for the acceptance of the grant.

 

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1.                     The Mayor and/or his designee, the Business Administrator, are hereby authorized to enter into and execute an Agreement with the Triborough Bridge and Tunnel Authority, a public benefit corporation of the State of New York, 2 Broadway, New York, NY 10004 (“TBTA”) to receive and expend Grant Funds in the amount of Three Million Three Hundred Twenty-Five Thousand and Zero Cents ($3,325,000.00) (the “Newark Earmark”) for a transformative greening initiative focused on planting 1,000 new street trees and creating 1,000 tree pits on corridors near bus stops, schools, homes, and areas with high traffic to provide shade, cooling, and pollution filtration to be performed by the City of Newark in accordance with the Scope of Work, Budget and Schedule (the “Newark Roadside Vegetation Plan”) for the Period of September 1, 2026 through August 31, 2029. (a copy of the Mitigation Activities Agreement is attached hereto and made a part hereof).

 

2.                     The Newark Earmarked Grant Funds in the amount of Three Million Three Hundred Twenty-Five Thousand and Zero Cents ($3,325,000.00) is hereby accepted (a copy of the Mitigation Activities Agreement is attached hereto and made a part hereof).

 

3. The Municipal Council hereby ratifies acceptance of this award from September 1, 2026 to the date of this Authorizing Resolution.

 

4. No Changes shall be made to the terms and conditions of this Agreement without prior Municipal Council approval.

 

5.                     The Business Administrator shall, upon any extension of time of the grant and/or upon any increase or decrease of the Grant funds, submit to the Municipal Council for its consideration an amending resolution reflecting the final time and amount of the awarded Grant.

 

7. No Municipal matching funds are required for the receipt or acceptance of this Gant Award

 

8.                     The Business Administrator shall file a copy of a fully executed Grant Agreement, in the office of the City Clerk.

 

 STATEMENT

No matching Municipal funds are required for the receipt or acceptance of these Grant Funds.
