This Resolution authorizes the City of Newark to apply for grant funding under the LFIF-2026-Fabyan Place Freight Improvement - 00042 from NJDOT for improvements to Fabyan Place. It also authorizes the acceptance of grant funding upon notification of a grant award

WHEREAS, the State of New Jersey Department of Transportation ("NJDOT") FY 2026Local Freight Impact Fund (LFIF) Grant Program ("Grant Program") provides funding for transportation projects that address the impact of freight travel to local communities and local transportation infrastructures; and

WHEREAS, the City of Newark (the "City") seeks to obtain funding from Grant Program for improvements to Fabyan Place, which includes milling and paving 2-1/2" to 3", reconstruction of curbs and ADA ramps, crosswalks, new pavement markings, storm water system cleaning and replacement as needed, replacement of broken or worn water valve boxes, manhole frames and covers, and sidewalks on both sides of the street ("Fabyan Place Freight Improvements"); and

WHEREAS, the City desires to further the public interest by obtaining funding for the Fabyan Place Improvements; and

WHEREAS, on December 17, 2025 on behalf of the City, the Acting Director of the Department of Engineering electronically submitted: an application to NJDOT requesting grant funding in the amount of One Million One Hundred Twenty-Four Thousand, Seven Hundred Ninety Nine Dollars and Zero Cents ($1,124,799.00) for the Fabyan Place Freight Improvements with no City funds required; and

WHEREAS, as a part of the grant application (a copy of which is attached hereto) the City of Newark is required to submit a Resolution from the Municipal Council authorizing the submission of the grant application; and

WHEREAS, upon notification of the receipt of a grant award in connection with the application, the Acting Director of the Department of Engineering desires to accept such award and to enter into any grant agreement necessary to receive and expend the grant award; and

WHEREAS, prior to executing any such grant agreement, the Acting Director of the Department of Engineering shall submit a copy of said agreement to the City Clerk, the Corporation Counsel and the Business Administrator for their review and approval.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized to submit an electronic grant application, identified as LFIF-2026- Fabyan Place Freight Improvements, to the New Jersey Department of Transportation ("NJDOT"), on behalf of the City of Newark, requesting grant funding in the amount of One Million One Hundred Twenty-Four Thousand, Seven Hundred Ninety Nine Dollars and Zero Cents ($1,124,799.00) from the FY 2026 Local Freight Impact Fund Grant Program ("Grant Program") for the construction of the Fabyan Place Freight Improvements.

2. The Municipal Council hereby ratifies its authorization of the application from the date of application submission to the date of adoption of this authorizing Resolution.

3. Upon notification of the receipt of any grant award in connection with the application, such grant award is hereby accepted in the amount awarded.

4. Furthermore, upon notification of a grant award, the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to enter into and execute a grant agreement with NJDOT and to take any other steps necessary to receive and expend the grant award from the Grant Program.

5. The Acting Director of the Department of Engineering shall submit a final copy of the grant agreement and any ancillary documents to the City Clerk, the Corporation Counsel and the Business Administrator for their review and approval.

6. No municipal funds are required for the receipt or acceptance of the grant award.

7. The Acting Director of the Department of Engineering shall file a fully-executed copy of the grant application, the award letter, and the grant agreement in the Office of the City Clerk.


STATEMENT

This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to submit an electronic grant application for, accept any resulting grant award, and enter into any necessary grant agreement for grant funding in the amount of $1,274,799.00 from the New Jersey Department of Transportation FY 2026 Local Freight Impact Fund Grant Program for construction of the Fabyan Place Freight Improvements in the City of Newark. No municipal funds are required in connection with this grant award
