The NWDB is gifting both 2022 Ford Ecosport transportation vehicles to the City of Newark. The NWDB fully understands and agrees that they are not entitled to receive any direct benefit from the City of Newark in exchange for its gift/donation.
No municipal funds will be expended for acceptance of this gift.

WHEREAS, the Newark Workforce Development Board (hereinafter “NWDB”), is a 501(c)(3) non-profit organization; and
WHEREAS, the NWDB’s mission is to lead and empower the City of Newark’s workforce system by leveraging assets and resources to ensure the educational, professional and economic success of Newark residents, and the prosperity of businesses in our community; and
WHEREAS, the NWDB, under the direction of Mayor Ras J. Baraka’s Office of Workforce Development, is responsible for strategic policy and oversight of the City of Newark’s workforce development; and
WHEREAS, the NWDB has raised Sixty Thousand Nine Hundred Eighty-Five Dollars and Thirty-Eight Cents ($60,985.38) towards the procurement of two (2) 2022 Ford Ecosport transportation vehicles to help promote drive workforce development within the City of Newark by providing additional agency resources for staff to facilitate and deliver career fairs, program resources, and employment opportunities directly within resident communities; and
WHEREAS, upon receipt of the two (2) 2022 Ford Ecosport transportation vehicles, the NWDB is gifting both vehicles to the City of Newark; and
WHEREAS, the total combined cost of the two (2) 2022 Ford EcoSport transportation vehicles is Sixty Thousand Nine Hundred Eighty-Five Dollars and Thirty-Eight Cents ($60,958.38), and the invoice for the same is attached; and
WHEREAS, the cost of the vehicles are broken down below; and

WHEREAS, the Mayor’s Office of Workforce Development desires to accept this gift of two (2) 2022 Ford Ecosport transportation vehicles, pursuant to N.J.S.A. 40A:5-29; and
WHEREAS, no municipal funds will be expended for the acceptance of this gift; and
WHEREAS, all personnel operating and/or utilizing these vehicles will be required to execute and abide by the City of Newark’s Motor Vehicle Operator’s Responsibilities form, and the same is attached herein; and
WHEREAS, the NWDB fully understands and agrees that they are not entitled to receive any direct benefit from the City of Newark in exchange for its gift/donation; and
WHEREAS, pursuant to Local Public Contracts Law, N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies and gifts made to it and is empowered to utilize such bequests, legacies and gifts in the manner set forth in the conditions of the bequest, legacy or gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of America.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Business Administrator, are authorized, pursuant to N.J.S.A. 40A:5-29, to accept the gift of two (2) 2022 Ford EcoSport transportation vehicles to accommodate staff and facilitate transport of equipment to career fairs and places of employment, with an estimated value of Sixty Thousand Nine Hundred Eighty-Five Dollars and Thirty-Eight Cents. ($60,958.38).
2. No municipal funds will be expended for the acceptance of this gift/donation.
3. All personnel operating and/or utilizing these vehicles will be required to execute and abide by the City of Newark’s Motor Vehicle Operator’s Responsibilities form.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark, and/or his designee, the Business Administrator to accept a gift/donation from the Newark Workforce Development Board, 990 Broad Street, Newark, New Jersey 07102, of two (2) 2022 Ford EcoSport transportation vehicles to accommodate staff and facilitate transport of equipment to career fairs and places of employment, with an estimated value of $60,985.38. All funding will be paid via donation to the City of Newark and no municipal funds will be used towards the cost of the two (2) 2022 Ford Ecosport transportation vehicles.
