WHEREAS, an emergency has arisen in the Special Item of Appropriation in the amount of Seventy-Two Thousand Eight Hundred Sixty-Eight Dollars and Zero Cents ($72,868.00) for The Truancy Alternative Program (TAP) and no adequate provision has been made in the 2023 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the purpose abovementioned; and
WHEREAS, by an award letter dated November 2, 2022, from the County of Essex, Department of Citizen Services, the City of Newark (the "City) was awarded funding for TAP Program in the amount of Seventy-Two Thousand Eight Hundred Sixty-Eight Dollars and Zero Cents ($72,868.00) to provide funds for program operations; and
WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, the emergency appropriations adopted in 2023, pursuant to N.J.S.A. 40A:4-20, including this Resolution total $316,465,727.54.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Governing Body by a two-thirds vote of its full membership is hereby making the following temporary emergency appropriation.
2. An emergency appropriation be and the same is hereby made for the following classification

Truancy Alternative Program (TAP) $72,868.00
3. This appropriation shall relate back to January 1, 2023 to the date of adoption of this Resolution.
4. Said emergency appropriation shall be provided for in the 2023 Budget.
5. A copy of this Resolution shall be filed with the Director of the Division of Local Government Services by the Acting City Clerk.
STATEMENT
This Resolution establishes an appropriation and revenue in the 2023 City of Newark's Budget for the Truancy Alternative Program (TAP) in the amount of $72,868.00. These funds have been awarded by the County of Essex, Department of Citizen Services. The project period is January 1, 2023 through December 31, 2023. This appropriation shall relate back to January 1, 2023 to the date of adoption of this Resolution.
