WHEREAS, pursuant to N.J.S.A. 40:9-120 et seq., the City of Newark may appoint up to fifty (50) Constables; and
WHEREAS, pursuant to N.J.S.A. 40A:9-121, the City of Newark may appoint a Constable for a term of three (3) years unless the Municipal Council, by its resolution of appointment, fixes a one (1) year term; and
WHEREAS, the City of Newark wishes to appoint Abraham Maury to serve as a Constable for a term of three (3) years.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Abraham Maury, of Newark, New Jersey 07107, is hereby appointed as a Constable, in accordance with his application, to serve civil and criminal warrants, written summonses, subpoenas, complaints, repossessions, lockouts, legal documents, small claims and writs of execution.
2. Prior to carrying out the duties of his office and no later than thirty (30) days after the effective date of the appointment, the aforesaid appointee shall submit a Constable Bond, which shall be approved as to form, amount, and sufficiency of Surety by Resolution of the Municipal Council.
3. This appointment shall be for a term of three (3) years from the date of appointment or the expiration of the Constable bond, whichever occurs first.
STATEMENT
This Resolution hereby authorizes the appointment of Abraham Maury, of Newark, New Jersey 07107, to serve as a Constable in the City of Newark for a period of three (3) years from the date of the appointment or the expiration of the Constable Bond, whichever occurs first.
