ORDINANCE TO AMEND TITLE 15, CHAPTER 12, NEWARK MANDATORY RECYCLING REGULATIONS, SECTION 7, TIME OF PLACEMENT, OF THE REVISED ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, AS AMENDED AND SUPPLEMENTED TO REVISE THE HOURS OF PLACEMENT ON THE CURB OF RECYCLABLE MATERIALS PRIOR TO COLLECTION

WHEREAS, the Department of Public Works desires to change the hours for placement at the curb of recyclable materials to be collected by the City or agents thereof; and
WHEREAS, the change will shorten the time that recyclable materials will be on the curb, thereby reducing exposure to animals, weather, and other conditions that contaminate the materials and potentially clutter the sidewalks and streets; as such, the change in hours for placement of the materials will improve the environment and the health and safety of the City’s residents.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

Section 1. 15:12-7 Newark Mandatory Recycling Regulations, Time of Placement of the Revised General Ordinances of the City of Newark, New Jersey, as amended and supplemented, be amended as follows:
Recyclable materials to be collected by the City of Newark, or agents thereof, shall be placed at the curb on those days specifically specified by the City of Newark. In no event shall recyclable materials be placed in the street or the sidewalks, nor shall they be placed in plastic bags for collection. Recyclable materials shall be placed at the curb in proper durable reusable containers between the hours of 7:00pm and 10:00pm the evening before the scheduled collection day of the recyclable materials. not earlier than 7:00 p.m. on the day before regular municipal collection and not later than 7:00 a.m. on the day of regular municipal collection.
Section 2. Any prior ordinances or parts thereof inconsistent herewith are hereby repealed and superseded by this Ordinance.
Section 3. If any part of the Ordinance is declared unconstitutional or illegal, the remaining provisions shall continue in full force and effect.
Section 4. This Ordinance shall take effect upon final passage and publication in accordance with the laws of the State of New Jersey.
STATEMENT
This Ordinance amends and supplements Title 15, Chapter 12 Newark Mandatory Recycling Regulations, Section 7, Time of Placement, to the hours between 7:00pm and 10:00pm the evening before the scheduled collection day of the recyclable materials.
