Resolution 7R3-a, adopted on December 21, 2022, authorized the City to apply for and accept grant funding in the amount of $2,219,581.00 from the New Jersey Department of Transportation's (NJDOT) Local Freight Impact Fund (LFIF) Grant Program.
This Resolution will amend Resolution 7R3-a, adopted on December 21, 2022, to apply for and accept $2,096,000.00 in grant funding.

WHEREAS, the New Jersey Department of Transportation's (NJDOT) Local Freight Impact Fund (LFIF) Grant Program provides funding for transportation projects that address the impact of freight travel to local communities and local transportation infrastructures; and
WHEREAS, on December 12, 2022, on behalf of the City of Newark, the Director of the Department of Engineering submitted LFIF-2023-Foundry Street Resurfacing Improve-00024 applications electronically to NJDOT requesting grant funding in the amount of $2,219,581.00 for the Foundry Street Resurfacing Improvement with no City funds required; and
WHEREAS, as a result of the above application, the City of Newark (the "City") received notice on April 10, 2023, (a copy of the NJDOT approval letter is attached hereto and made a part hereof) that it has been awarded a grant in the amount of Two Million Ninety-Six Thousand Dollars and Zero Cents ($2,096,000.00) from the NJDOT's Local Freight Impact Fund Fiscal Year 2023 for Foundry Street Resurfacing Improvement, with no City funds required; and
WHEREAS, the Department of Engineering wants to amend Resolution 7R3-a, adopted on December 21, 2022, to authorize the execution of an Agreement with NJDOT the New Jersey Department of Transportation and accept grant funds for Two Million Ninety-Six Thousand Dollars and Zero Cents ($2,096,000.00) from the Local Freight Impact Fund (LFIF) Grant Program for Foundry Street Resurfacing Improvement.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R3-a, adopted on December 21, 2022, is hereby amended to authorize the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to accept the grant award in the amount of Two Million Ninety-Six Thousand Dollars and Zero Cents ($2,096,000.00) from the New Jersey Department of Transportation's (NJDOT) Local Freight Impact Fund (LFIF) Grant Program (a copy of the NJDOT grant award approval letter is attached hereto and made a part hereof).
2. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the NJDOT to receive and expend the grant award in the amount of Two Million Ninety-Six Thousand Dollars and Zero Cents ($2,096,000.00) from the New Jersey Department of Transportation's (NJDOT) Local Freight Impact Fund (LFIF) Grant Program.
3. No municipal funds are required for receipt or acceptance of this grant award.
4. The Acting Director of the Department of Engineering shall file a fully executed copy of the grant application, the grant award letter, the final authorization letter, and the grant/project agreement in the Office of the City Clerk.

This Resolution amends Resolution 7R3-a adopted December 21, 2022, and authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to accept the grant award in the amount of $2,096,000.00 from the New Jersey Department of Transportation's (NJDOT) Local Freight Impact Fund (LFIF) Grant Program. No City funds are required.
