WHEREAS, the City of Newark (“City”) is the owner of the park located at 378 Lyons Avenue, Newark, New Jersey 07112 and commonly known as Bo Porter Sports Complex (“Park”); and

 

WHEREAS, the City is desirous of improving the Park for the use and enjoyment of the public; and

 

WHEREAS, Urban Initiative, LLC, of Summit, New Jersey 07901 (“Urban Initiative”), is a charitable organization located in New Jersey whose mission is to create more socioeconomic and ethnic diversity within the sport of soccer by providing premier soccer turf facilities and free coaching instruction to children living in underserved communities across the State of New Jersey; and

 

WHEREAS, Urban Initiative in partnership with Newark Beth Israel Medical Center and Children’s Hospital of New Jersey, a RWJ Barnabas health facility, is gifting equipment, materials and labor valued at approximately Sixty Five Thousand Dollars and Zero Cents ($65,000.00), to the City of Newark (preliminary estimate attached as Exhibit A) for the construction of a Futsol Soccer Court at the Park (“Soccer Court”); and

 

WHEREAS, Urban Initiative has selected Athletic Fields of America as its vendor for the Soccer Court; and

 

WHEREAS, the location of the Soccer Court at the Park will be in the area behind the batting cage consistent with the aerial Photograph as marked in yellow, which is attached as Exhibit B; and 

 

WHEREAS, the Soccer Court shall be consistent with the engineering drawing prepared by Phil Pirro, Jr., P.E. dated May 14, 2021, which is attached hereto as Exhibit C; and

 

WHEREAS, Urban Initiative shall participate in programming at the Park at the request of the Director of the Department of Recreation, Cultural Affairs and Senior Services; and

WHEREAS, pursuant to Local Public Contracts Law, N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies and gifts made to it and is empowered to utilize such bequests, legacies and gifts in the manner set forth in the conditions of the bequest, legacy or gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of America; and

 

WHEREAS, Urban Initiative fully understands and agrees that they are not entitled to receive any direct benefit from the City of Newark in exchange for its gift; and

 

WHEREAS, the Department of Recreation, Cultural Affairs and Senior Services desires to accept the gift of equipment, materials and labor for the construction of the Soccer Court, pursuant to N.J.S.A. 40A:5-29.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designee, the Business Administrator and/or the Director of the Department of Recreation, Cultural Affairs and Senior Services to accept the gift, from Urban Initiative, LLC, of Summit, New Jersey 07901 (“Urban Initiative”), in partnership with Newark Beth Israel Medical Center and Children’s Hospital of New Jersey, a RWJ Barnabas health facility, of equipment, materials, and labor valued at approximately Sixty-Five Thousand Dollars ($65,000.00) for the construction of a Futsol Soccer Court (“Soccer Court”), at Bo Porter Sports Complex, located at 378 Lyons Avenue, Newark, New Jersey 07112 (“Park”), in the location behind the batting cage as depicted in the aerial photograph as marked in yellow, which is attached as Exhibit B.

 

2.                     The Soccer Court shall be consistent with the engineering drawing prepared by Phil Pirro, Jr., P.E., dated May 14, 2021, which is attached as Exhibit C.

 

3.                      The gift award letter from Urban Initiative shall be filed in the Office of the City Clerk by the Director of the Department of Recreation, Cultural Affairs and Senior Services.

 

4.                     Urban Initiative shall participate in programming at the Park at the request of the Director of the Department of Recreation, Cultural Affair and Senior Services.

 

5.                     No municipal funds will be expended for the acceptance of this gift.

 

 

STATEMENT

 

This resolution authorizes the Mayor and/or his designee, the Business Administrator, and/or the Director of the Department of Recreation, Cultural Affairs and Senior Services to accept a gift from Urban Initiative, LLC, of Summit, New Jersey 07901, in partnership with Newark Beth Israel Medical Center and Children’s Hospital of New Jersey, a RWJ Barnabas health facility, for equipment, materials and labor valued at approximately $65,000.00, for the improvement of Bo Porter Sports Complex.  No municipal funds will be expended for the acceptance of this gift.
