WHEREAS, Ms. Michelle Fisher, of Newark, New Jersey 07106, would like to donate Gym Equipment: one (1) Jump Box, one (1) Weight Rack, one (1) Weight Bar, one (1) Workout Bench, twenty-two (22) Olympic Size Weights, one (1) Treadmill, one (1) Workout Rack and Accessories, one (1) Free Standing Pull Up Bar, Various Sized Dumbbells and four (4) Gym Mats to the City of Newark (City), Boylan Street Recreation Center located at 916 South Orange Avenue, Newark, New Jersey 07106. The gym equipment has a value of approximately Seven Thousand Dollars and Zero Cents ($7,000.00); and
WHEREAS, the Director of the Department of Recreation, Cultural Affairs & Senior Services (“Department”) desires to accept the gift of the Gym Equipment: one (1) Jump Box, one (1) Weight Rack, one (1) Weight Bar, one (1) Workout Bench, twenty-two (22) Olympic Size Weights, one (1) Treadmill, one (1) Workout Rack and Accessories, one (1) Free Standing Pull Up Bar, Various Sized Dumbbells and four (4) Gym Mats and acknowledges the donation; and
WHEREAS, the City desires to expand and enrich the recreational opportunities to the residents of Newark by accepting the generous donation; and
WHEREAS, Ms. Michelle Fisher fully understands and agrees that she is not entitled to receive any benefit from the City, Mayor Ras J. Baraka, or any other personnel affiliated with the City in exchange for the gift; and
WHEREAS, pursuant to Local Public Contracts Law, N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies and gifts made to it and is empowered to utilize such bequests, legacies and gifts in the manner set forth in the conditions of the bequest, legacy or gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of America.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Recreation, Cultural Affairs & Senior Services are authorized to accept the gift from Ms. Michelle Fisher, of Newark, New Jersey 07106, consisting of Gym Equipment: one (1) Jump Box, one (1) Weight Rack, one (1) Weight Bar, one (1) Workout Bench, twenty-two (22) Olympic Size Weights, one (1) Treadmill, one (1) Workout Rack and Accessories, one (1) Free Standing Pull Up Bar, Various Sized Dumbbells and four (4) Gym Mats, for the Boylan Street Recreation Center located at 916 South Orange Avenue, Newark, New Jersey 07106, to make gym equipment accessible to Newark residents who desire to participate in workout programs.
2. This gift of Gym Equipment: one (1) Jump Box, one (1) Weight Rack, one (1) Weight Bar, one (1) Workout Bench, twenty-two (22) Olympic Size Weights, one (1) Treadmill, one (1) Workout Rack and Accessories, one (1) Free Standing Pull Up Bar, Various Sized Dumbbells and four (4) Gym Mats to the City of Newark, Boylan Street Recreation Center to make equipment accessible to Newark residents is valued at approximately Seven Thousand Dollars and Zero Cents ($7,000.00).
3. The City acknowledges the generous donation of Gym Equipment: one (1) Jump Box, one (1) Weight Rack, one (1) Weight Bar, one (1) Workout Bench, twenty-two (22) Olympic Size Weights, one (1) Treadmill, one (1) Workout Rack and Accessories, one (1) Free Standing Pull Up Bar, Various Sized Dumbbells and four (4) Gym Mats through this resolution.
4. No municipal funds will be expended for the acceptance of this gift.

The gift is valued at approximately $7,000.00. No municipal funds will be expended for the acceptance of this gift.
