Additional Information: 

Extension of Emergency Contract #E2020-24 to extend the provision of temporary shelter operation services during Code Blue and the COVID-19 pandemic.

The First Extension of Emergency Contract #2020-24 was adopted as 7R1-b(S/A) on March 23, 2021 in an amount not to exceed $83,475.70 for the period of March 16, 2021 through June 16, 2021.

 WHEREAS, on December 15, 2020, the Department of Administration requested a declaration of emergency to construct temporary shelter containers and provide shelter operation services during Code Blue for the health, safety and welfare of the residents of the City of Newark; and

 

WHEREAS, on December 16, 2020, the City’s Purchasing Agent, QPA, declared an emergency and awarded an Emergency Contract for the period of December 15, 2020 through March 15, 2021, in the amount of Six Hundred Thirty-Three Thousand, Three Hundred Seventy-Five Dollars and Zero Cents ($633,375.00) to: Home 4 the Homeless, 3362 Fulton Road, Fulton, California 95439 and United Community Corporation, 332 South 8th Street, Newark, New Jersey 07103 (the “Vendors”).  (A copy of Emergency Contract #E-2020-24 is attached hereto and made a part of this resolution); and

 

WHEREAS, the Department of Administration is in immediate and emergent need for United Community Corporation to continue to provide shelter operation services for the temporary container shelters to the residents in the City of Newark for the period of June 17, 2021 through December 31, 2021 or until the need for the shelter services no longer exists or services are performed pursuant to a fully executed contract; and

 

WHEREAS, N.J.S.A. 40A:11-6 provides that Emergency Contracts may be entered into when an emergency affecting the public health, safety or welfare requires the immediate delivery of goods or the performance of services; and

 

WHEREAS, N.J.A.C. 5:34-6.1(a)3 provides that the emergency purchasing procedure may be used when the need for such goods or services has arisen notwithstanding a good faith effort on the part of a municipality to plan for the purchase of any goods or services required by the municipality; and

 

WHEREAS, the Department of Administration, as a result of unforeseen events, desires to extend the duration of Emergency Contract #E2020-24 under the same terms and conditions for the same compensation rate for a total amount not to exceed One Hundred Sixty-Six Thousand Seven Hundred Fifty Dollars and Zero Cents ($166,750.00) for the provision of services; and

 

WHEREAS, the delivery and receipt of the Temporary Shelter Housing Solution Containers, for use during weather necessities in the City of Newark, were delayed because of, among other things, the storms and traffic collision problems in Texas (unforeseeable events); and

 

WHEREAS, the delay in the delivery and receipt of the containers by the City prevented the commencement of services to the intended occupants of the housing containers; and

 

WHEREAS, the services of United Community Corporation, 332 South 8th Street, Newark, New Jersey 07103, to the City of Newark (the “City”), is not only a key component of the City’s alternative housing solution, but also is essential to the protection of the health, safety and welfare of the residents of the City and residents without addresses during the COVID-19 pandemic; and

 

WHEREAS, it is a matter of public health and welfare that the above-described Emergency Contract be extended because the City still needs to ensure the safety of the residents of the City of Newark; and

 

WHEREAS, City Ordinance 6PSF-e adopted on April 6, 2011, Newark R.O. 2:5-13.2 (E)(1)(b) and (c) limits the period of Emergency Contracts to ninety (90) days and no extensions of Emergency Contracts shall be permitted without authorization by the Municipal Council by resolution; and

 

WHEREAS, the Department of Administration now seeks authorization by the Municipal Council to extend the emergency to continue to provide shelter operation services for the temporary container shelters during Code Blue and the COVID-19 pandemic.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Business Administrator, are authorized to extend Emergency Contract #E2020-24 with United Community Corporation, 332 South 8th Street, Newark, New Jersey 07103, for the term of June 17, 2021 through December 31, 2021 or until services are fully performed for a total amount not to exceed One Hundred Sixty-Six Thousand Seven Hundred Fifty Dollars and Zero Cents ($166,750.00).

 

2.                     This extension will allow for the continuation of shelter operation services of the temporary container shelters in the City of Newark.

 

3.                     The extension of Emergency Contract #E2020-24 is ratified from June 16, 2021 to the date of adoption of this authorizing resolution.

 

4.                     For any and all expenditures against this contract, a Certification of the availability of sufficient funds, as required by N.J.A.C. 5:30-5.5(b)(2), shall be executed before a contractual liability is incurred each time an order is placed from Account Code Line: Department of Health Social Services Budget/011-120 -1205-72090-B2020. This contract shall not exceed One Hundred Sixty-Six Thousand Seven Hundred Fifty Dollars and Zero Cents ($166,750.00). Attached hereto is a Partial Certification of Funds in the amount of Eighty-Three Thousand Four Hundred Seventy-Five Dollars and Zero Cents ($83,475.00) from the Director of the Department of Finance. 

 

5.                     The City’s Qualified Purchasing Agent has filed a copy of the Emergency Contract #E2020-24, attached hereto, with the Office of the City Clerk.

 

6.                     If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

 

 

STATEMENT

 

This resolution ratifies and authorizes the Mayor and/or his designee, the Business Administrator, to extend Emergency Contract #E2020-24 with United Community Corporation, 332 South 8th Street, Newark, New Jersey 07103, to continue to provide shelter operation services for the temporary container shelters for the term of June 17, 2021 through December 31, 2021 until the need for the shelter services no longer exists or services are performed pursuant to a fully executed contract for a total amount not to exceed $166,750.00.
