This Resolution authorizes the City of Newark to request an extension of time (until April 30, 2026) from NJDOT to award a contract for construction of the Municipal Aid Program for Street Resurfacing - MA-2024, with no City funds required.

WHEREAS, the State of New Jersey Department of Transportation (“NJDOT”) State Aid to Counties and Municipalities FY2024 Municipal Aid Program (“NJDOT Municipal Aid Program”) provides grant funding for the improvement and construction of local, municipal, and county road and bridge projects; and
WHEREAS, on or about June 25, 2023, the Acting Director of the Department of Engineering, on behalf of the City of Newark (the “City”), submitted an application to NJDOT requesting grant funding from the NJDOT Municipal Aid Program for Street Resurfacing - MA-2024 within the City of Newark, with no City funds required; and
WHEREAS, on July 11, 2023, the Municipal Council adopted Resolution 7R3-a (s) ratifying and authorizing the Director of the Department of Engineering to apply for, accept, and enter into a grant agreement for a grant award for the LA-2024 MA Newark City Five Ward Pavement Improvement Project 07 (“Municipal Aid Program for Street Resurfacing - MA-2024” or “Project”); and
WHEREAS, as a result of the grant application, on November 1, 2023, NJDOT announced that the City was selected to receive a grant award in the amount of $3,006,433.00; and
WHEREAS, NJDOT requires the City to award a contract for the Project within two (2) years of the announcement of the receipt of a grant award; and
WHEREAS, due to the design and coordination for utility infrastructure, the award has been delayed; and
WHEREAS, the Department of Engineering wishes to request that the NJDOT allow the City until April 30, 2026 to award a contract for construction of the Project.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
The Mayor of the City of Newark and/or his designee the Acting Director of the Department of Engineering, is hereby authorized to request from the New Jersey Department of Transportation an extension until April 30, 2026 to allow the City of Newark to award a contract in connection with the LA 2024 MA Newark City Five Ward Pavement Improvement Project 07 grant award.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to request an extension from NJDOT to allow the City of Newark to award a contract for construction of Municipal Aid Program for Street Resurfacing - MA-2024 by April 30, 2026. No municipal funds are required.
