WHEREAS, pursuant to a fair and open process Resolution 7R12-b adopted on January 8, 2025, authorized the Director of the Department of Water and Sewer Utilities, to enter into and execute a contract with Michael Baker International, Inc., One Gateway Center #1601, Newark, New Jersey 07102, to provide Professional Engineering Services on an As-Needed Basis, in an amount not to exceed $150,000.00 and for a contract period from January 1, 2025 through December 31, 2025, and when applicable may extend beyond, as authorized by N.J.S.A. 40A:11-15(9) for the duration of the Project; and
WHEREAS, the Department of Water and Sewer Utilities requested and received a proposal dated May 1, 2025 to perform Task 1 - Cedar Grove Reservoir Security Fence, in the amount of $148,876.00; and
WHEREAS, per Michael Baker International’s email dated June 6, 2025, an additional amount of $23,402.00 is needed for Task 1, due to unanticipated site conditions related to the wetlands delineation, for the Cedar Grove Reservoir Security Fence; and
WHEREAS, the Department of Water and Sewer Utilities requested and received a proposal dated August 15, 2025 to perform Task 2 - Peripheral Ditch E Peddie to Newark Airport Rehabilitation/Sediment Removal, in the amount of $56,564.16; and
WHEREAS, a combined additional amount of $78,842.16 is needed in the contract, to cover the additional costs of Task 1 (Cedar Grove Reservoir Fence) and Task 2 (Peripheral Ditch E Peddie to Newark Airport Rehabilitation/Sediment Removal); and
WHEREAS, the Department of Water and Sewer Utilities wishes to execute Amendment No. 1 for an increase of the contract amount by $78,842.16 with Michael Baker International, Inc., to continue providing Professional Engineering Services on an As-Needed Basis to cover the additional costs of Task 1 (Cedar Grove Reservoir Security Fence) and Task 2 (Peripheral Ditch E Peddie to Newark Airport Rehabilitation/Sediment Removal), as more fully set forth in the scope of services detailed in the attached Michael Baker International letters dated June 6, 2025 (Task 1 additional work email letter) and August 15, 2025 (Task 2 proposal letter).
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Major and/or his Designee, the Director of the Department of Water and Sewer Utilities, are authorized to enter into and execute Amendment No.1 with Michael Baker International, Inc., One Gateway Center #1601, Newark, New Jersey 07102, to provide Professional Engineering Services on an As-Needed Basis for an additional $78,842.16 for a total contract amount not to exceed $228,842.16.
2. Pursuant to N.J.A.C. 5:30-5.5(a), Temporary Budget, attached hereto is a partial Certification of Funds issued by the Director of the Department of Finance, which state that there are available sufficient legally appropriated funds in the amount of $5,000.00 for the purposes set forth herein, under NW037-750-7502-71280-B2026 the certification shall be filed along with the original resolution in the Office of the City Clerk. The remainder of the funding for this contract will be subject to appropriation in the 2026 Budget and funds will be certified prior to services being provided by the contractor.
3. The Director of the Department of Water and Sewer Utilities shall file a duly executed copy of the Amendment No. 1 to the Agreement in the Office of the City Clerk.
4. All other Terms and Conditions of the contract remain the same.
5. A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within ten (10) days of the adoption of this resolution.
STATEMENT
This Resolution amends and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, to enter into and execute Amendment No. 1 with Michael Baker International, Inc., to continue to provide Professional Engineering Services on an As-Needed Basis for an additional $78,842.16, for a total contract amount not to exceed of $228,842.16.
