       WHEREAS, on December 8, 2011, the City of Newark received bid proposals for the Recycling of Use Tires, and prepared legislation for the award of a contract to the lowest responsible bidder, Waste Management of New Jersey, Inc., which legislation has not been adopted by Municipal Council; and
 
      WHEREAS, in the absence of a contract to recycle or dispose of used tires, the Department of Neighborhood and Recreational Services, on December 20, 2012, declared an emergency regarding the collection of used tires in the City of Newark and awarded an Emergency Contract to Waste Management of New Jersey, Incorporated, 107 Silvia Street, Ewing, New Jersey 08628; and
 
      WHEREAS,  the Department of Neighborhood and Recreational Services, requests an extension of the emergency contract with Waste Management of New Jersey, Incorporated, 107 Silvia Street, Ewing, New Jersey 08628and
 
WHEREAS,  the area of collection will include the South Ward, West Ward, North Ward, East Ward, Central Ward and the Central Business District all in the City of Newark; and
 
WHEREAS,   It is imperative that the City of Newark remove used tires because the tires are not only an eye sore, but they are a breeding ground for mosquitoes that pose an immediate risk to the safety and health of City of Newark  residents and the public, generally.  In addition, the Department of Environmental Protection has requested the removal of used tires, which are health and public safety risks; and
 
      WHEREAS, the cost for removal of the used tires remains at $229.00 per ton disposal,  totaling an amount not to exceed, $100,000.00, for a term that does not exceed three (3) months; and
 
WHEREAS, pursuant to N.J.A.C 5:34-6.1, the City is in need of an extension of the existing emergency contract for removal of used tires because of an actual emergency;and
 
WHEREAS, City Ordinance 6PSF-e April 6, 2011 Article 2:5-13.2(E)(1) (b), (c), states that Emergency Contracts shall not be for a period in excess of ninety (90) days and no extensions of emergency contracts shall be permitted without authorization by the Municipal Council by resolution.
 
      
      NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Business Administrator requests authority to extend  the existing emergency contract with Waste Management of New Jersey, Incorporated, 107 Silvia Street, Ewing, New Jersey 08628, for the removal of illegally dumped used tires throughout the City of Newark.   The area of collection will include the South Ward, West Ward, North Ward, East Ward, Central Ward and the Central Business District all in the City of Newark.
 
2.      This extension will allow the continuity of Emergency Contract E2012-31, that commenced on February 1, 2013 through May 2, 2013. The extended contract term shall commence on June 3, 2013 and terminate on the earlier of December 1, 2013  or until the new contract is in place.
 
3.      Attached hereto is a budget detail document which shows that there are sufficient funds for the purpose set forth hereinabove. Business Unit 011, Department 160, Division 1604/1607, Account 71580 and B2013.
 
4.      An executed copy of said contract shall be filed with the Office of the City Clerk by the Business Administrator for the City of Newark.
 
5.      The total amount of said contact shall not exceed $100,000.00.
 
STATEMENT
 
This resolution authorizes the Mayor and/or his designees, the Business Administrator and the Director of the Department of Neighborhood and Recreational Services to extend for a term not exceeding three (3) months, the emergency contract with Waste Management of New Jersey, Incorporated, 107 Silvia Street, Ewing, New Jersey 08628, to provide services to remove illegally dumped used tires throughout the City of Newark, from June 3, 2013 through December 1, 2013 .
