WHEREAS, on October 27, 2015, the City of Newark through its Supervising Procurement Specialist, advertised to solicit bids for contractors to provide a 2015, or Newer 70 ft. Forestry Aerial Lift Truck to the Department of Neighborhood and Recreational Services, as per the bid proposal attached hereto; and
WHEREAS, the Division of Central Purchasing distributed six (6) bid proposal packages to prospective vendors following the date of advertisement; and
WHEREAS, on November 19, 2015 two (2) bids were received in response to this advertisement; and
WHEREAS, the Division of Motors reviewed the bids, and recommended that an award be made to the lowest responsive, responsible W.E. Timmerman Co. Inc.; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A: 11-1 et seq. meets the requirements of the fair and open process.
NOW, THERFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/ or his designee, the Supervising Procurement Specialist, are hereby authorized to enter into a contract with W. E. Timmerman Co., Inc., 3554 Route 20 West, PO 71, Whitehouse, New Jersey 08888, to provide a 2015 or Newer 70 ft. Forestry Aerial Lift Truck, to the City of Newark, whose bid was received on the advertised due date and determined to be the lowest responsive, responsible bidder in accordance with specifications,upon adoption of the resolution by the Municipal Council, the term of the contract will be established upon complete delivery, not to exceed March 31, 2016.
2. There shall be no amendments or changes in this contract without the approval of Newark Municipal Council.
3. Funds for this acquisition are encumbered on PO# 27713, Fund NW051, Account 71560, Budget Year B2015, for a total of $215,900.00. This contract shall not exceed $215,900.00.
4. It is the responsibility of the Director of the Department of Engineering, Division of Motors, to ascertain that the 2015 or Newer 70 ft. Aerial Lift Truck is in compliance with the specifications and will provide the Municipal Council, the Business Administrator and the Supervising Procurement Specialist, with appropriate reports during the term of the contract.
5. A duly executed copy of the contract shall be forthwith filed in the Office of the City Clerk by the Supervising Procurement Specialist.
6. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than 20 business days following such award, in accordance with N.J.S.A. 52:15C-10 and the notice of the Office of the State Comptroller dated May 7, 2008.
