WHEREAS, the State of New Jersey Department of Transportation ("NJDOT") FY2018 Local Freight Impact Fund ("NJDOT Local Freight Impact Fund") provides grant funding for transportation projects that address the impact of freight travel to local communities and local transportation infrastructures; and
WHEREAS, the City of Newark seeks to obtain funding from the NJDOT Local Freight Impact Fund to improve Foundry Street and Avenue P that include milling and paving 2 1/2" to 3", reconstruction of curbs and ADA ramps, sidewalks, crosswalks, new pavement markings, storm water system cleaning and replacement as needed, replacement of broken or worn water valve boxes, manhole frames and covers ("Foundry Street and Avenue P Resurfacing Improvements"); and
WHEREAS, the City of Newark desires to further the public interest by obtaining funding from the NJDOT Local Freight Impact Fund for the Foundry Street and Avenue P Resurfacing Improvements; and
WHEREAS, on December 19 2017, on behalf of the City of Newark, the Director of the Department of Engineering submitted an application to NJDOT requesting grant funding LFIF-2018-East Ferry Industrial Zone Port Co-00028 in the amount of $2,610,631.73 (Two Million Six Hundred Ten Thousand Six Hundred Thirty-One Dollars and Seventy Three Cents) from the NJDOT Local Freight Impact Fund to carry out the Foundry Street and Avenue P Resurfacing Improvements within the City of Newark, with no City funds required; and
WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City of Newark is required to submit a resolution from the Newark Municipal Council authorizing submission of the grant application; and
WHEREAS, upon notification of the receipt of a grant award in connection with the LFIF-2018-East Ferry Industrial Zone Port Co-00028 application, the Director of the Department of Engineering, desires to accept the grant award and execute a grant agreement governing said award; and
WHEREAS, upon notification of the receipt of a grant award in connection with LFIF-2018-East Ferry Industrial Zone Port Co-00028 application the Director of the Department of Engineering shall submit a copy of the grant agreement to the City Clerk, Acting Corporation Counsel and the Business Administrator for review, approval, and signature.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to submit an electronic grant application to the New Jersey Department of Transportation on behalf of the City of Newark, requesting grant funding in the amount of $2,610,631.73 (Two Million Six Hundred Ten Thousand Six Hundred Thirty-One Dollars and Seventy Three-Cents) from the NJDOT Local Freight Impact Fund to carry out the Foundry Street and Avenue P Resurfacing Improvements, with no City funds required (a copy of the application is attached hereto and made a part hereof).
2. The Municipal Council hereby ratifies its authorization of the LFIF-2018-East Ferry Industrial Zone Port Co-00028 application from the date of application submission to the date of adoption of this authorizing resolution.
3. Upon notification of the receipt of a grant award in connection with the LFIF-2018-East Ferry Industrial Zone Port Co-00028 application, the grant is hereby accepted in the amount applied for and/or any increase or decrease thereto.
4. Upon notification of the receipt of a grant award in connection with LFIF-2018-East Ferry Industrial Zone Port Co-00028 application, the Mayor and/or his designee, the Director of the Department of Engineering, is hereby authorized to enter into and execute grant documents with the New Jersey Department of Transportation to receive and expend the grant award from the NJDOT Local Freight Impact Fund to carry out the Foundry Street and Avenue P Resurfacing Improvements within the City of Newark:
5. Upon notification of the receipt of a grant award in connection with the LFIF-2018-East Ferry Industrial Zone Port Co-00028 application, the Director of the Department of Engineering shall submit a complete copy of the grant agreement and any associated documents to the City Clerk, Acting Corporation Counsel and the Business Administrator for review, approval, and signature.
6. No municipal funds are required for receipt or acceptance of this grant award.
7. The Director of the Department of Engineering shall file a fully-executed copy of the grant application, grant award letter, and grant agreement in the Office of the City Clerk.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to submit an electronic grant application for, accept, and enter into an agreement for grant funding from the New Jersey Department of Transportation, in the amount of $2,610,631.73 (Two Million Six Hundred Ten Thousand Six Hundred Thirty-One Dollars and Seventy Three Cents) from the FY2018 Local Freight Impact Fund. No municipal funds are required for receipt or acceptance of this grant award.
