WHEREAS, the City is the fee owner of the real properties located in the City of Newark, New Jersey located at 342-346, 348 Washington Street and 283-285, 287 Halsey Street, Newark, New Jersey 07102 being more particularly described on the Tax Map of the City of Newark, New Jersey as Block 96, Lots 8, 10, 32, & 33 (“City Properties”); and
WHEREAS, Public Service Electric and Gas (“PSE&G”), in order to provide safe and reliable service to the public, is in the process of upgrading the Newark Switching Station on certain real property owned by PSE&G and located at 343-357 Washington Street, Newark, New Jersey 07102, designated as Block 97, Lots 24, 26, 28, 30, & 31 on the Tax Map of the City of Newark (The “Project”), a critical facility serving the City of Newark’s electric distribution and transmission network; and
WHEREAS, PSE&G has determined that there is a necessary and valid public purpose to obtain a temporary, non-exclusive revocable construction access license agreement ("Temporary License Agreement") from Licensor over part of the City Property for staging purposes in order to carry out the Project and the City is willing to grant such Temporary License Agreement over a portion of the City Properties; and
WHEREAS, the City desires to grant PSE&G a Temporary License Agreement over portions of the City Properties for such purpose as hereinstated, for the amount of $132,405.00 for a term of three (3) years, commencing upon Municipal Council approval, with the option to extend such term for three separate one (1) year periods, subject to Municipal Council approval.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The aforementioned recitals are incorporated herein as though fully set forth at length.
2. The Mayor and/or his designee, the Acting Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a temporary, non-exclusive revocable construction access license agreement ("Temporary License Agreement"), in the form attached hereto as Exhibit A, between the City of Newark and PSE&G to use a portion of the properties located at 342-346, 348 Washington Street and 283-285, 287 Halsey Street, Newark, New Jersey 07102 designated as Block 96, Lots 8, 10, 32, & 33 on the Tax Map of the City of Newark, New Jersey, as more particularly described in Exhibit A to the Temporary License Agreement, for construction staging while PSE&G upgrades the Newark Switching Station on certain real properties owned by PSE&G and located at 343-357 Washington Street, Newark, New Jersey 07102, designated as Block 97, Lots 24, 26, 28, 30, & 31 on the Tax Map of the City of Newark, New Jersey (The “Project”), for the amount of $132,405.00.
3. The term of the Temporary License Agreement shall commence upon Municipal Council approval for a term of three (3) years, with the option to extend such term for three separate one (1) year periods, subject to Municipal Council approval.
4. A copy of this resolution and the fully executed Temporary License Agreement authorized herein shall be placed on file with the City Clerk’s Office by the Interim Deputy Mayor/Director of the Department of Economic and Housing Development.

This resolution ratifies and authorizes the City of Newark to enter into and execute a temporary, non-exclusive revocable construction access license agreement ("Temporary License Agreement"), in the form attached hereto, between the City of Newark and PSE&G to use a portion of the City Properties located at 342-346, 348 Washington Street and 283-285, 287 Halsey Street, Newark, New Jersey 07102 designated as Block 96, Lots 8, 10, 32, & 33 on the Tax Map of the City of Newark, New Jersey for construction staging while PSE&G upgrades the Newark Switching Station on certain real properties owned by PSE&G located at 343-357 Washington Street, Newark, New Jersey 07102 on Block 97, Lots 24, 26, 28, 30, & 31 (The “Project”), for the amount of $132,405.00, for a term of three (3) years commencing upon Municipal Council approval, with the option to extend such term for three separate one (1) year periods, subject to Municipal Council approval.
