WHEREAS, on February 28, 2017, the City of Newark (hereinafter “City”) through its Supervising Procurement Specialist, QPA, advertised to solicit bids for Nursing Services for Community Health, which the contractor will provide to the City of Newark, for the Department of Health and Community Wellness, as described in the attached bid proposal; to provide external contractual nursing agencies to sustain the professional nursing workforce at an adequate level, to provide quality nursing service to Newark residents at City facilities; and
WHEREAS, the Division of Central Purchasing distributed six (6) bid packages from its vendor list; and
WHEREAS, on March 16, 2017, the Division of Central Purchasing received one (1) bid in response to the City’s advertisement; and
WHEREAS, the Department of Health and Community Wellness reviewed the bid received and recommended that the award be made to National Staffing Associates, Inc., the only responsive and responsible bidder; and
WHEREAS, the Supervising Procurement Specialist, QPA, concurs with the recommendation that an award be made to the only responsive, responsible bidder, National Staffing Associates, Inc.; and
WHEREAS, pursuant to N.J.S.A. 40A:11-24a, the vendor agreed to hold the prices beyond 60 days; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitation through public bidding in accordance with N.J.S.A.40A:11-1 et seq. meets the requirement of the fair and open process as the law allows.
NOW, THEREFORE BE IT RESOLVED, BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Supervising Procurement Specialist, QPA, are hereby authorized to enter into and execute a contract with National Staffing Associates, Inc., 80 Main Street, Suite 100, West Orange, New Jersey 07052, for the provision of Nursing Service for the City of Newark, Department of Health and Community Wellness whose bid was received on the advertised due date and determined to be the only responsive and responsible bidder in accordance with the bid specifications. The term of the contract will be established for two (2) years.
2. There shall be no amendments or change to this contract without the approval of the Municipal Council by resolution.
3. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16. Funds for 2017 and subsequent years are contingent upon appropriations, pursuant to N.J.A.C.5:30-5.5(d) 2.
4. This is an open-ended contract to be used as needed during the term of the contract. Thus, for any and all expenditures against this contract, a certification of the availability of sufficient funds required by N.J.A.C. 5:30-5.5(b)2., shall be incurred each time an order is placed, covering the amount of service(s) from budget accounts NW026 - GLP - Account 46540; NW051 - G16 - Account 2H6G0 and NW011-120 - Account 71210. This contract shall not exceed $1,560,000.00 for a two (2) year term.
5. The Supervising Procurement Specialist, QPA, shall file a duly executed copy of this contract in the Office of the City Clerk.
6. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract, to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Supervising Procurement Specialist, QPA, to enter into a contract with National Staffing Associates, Inc., to provide Nursing Services for the Department of Health and Community Wellness, at a cost not to exceed $1,560,000.00, for a two (2) year term.
