Whereas, the Housing Authority of the City of Newark, Department of Central Maintenance and Capital Improvement (“NHA”) with address at 500 Mayor Kenneth A. Gibson Blvd, Newark, New Jersey, 07102 recognizes that it, at times, requires the services of a Sewer Vactor Jet/Rodder contractor to respond to sewer main backups and routine sewer inspection services; and
Whereas, the NHA has contracted for these services often experiencing significant delays in response time while incurring considerable expense for service calls made outside normal working hours and on holidays; and
Whereas, the NHA recognizes that timely response to these events is not only paramount to the health and welfare of its residents but is also to meet regulatory requirements under the State of New Jersey Department of Environmental Protection; and
Whereas, the City of Newark, Department of Water and Sewer Utilities (“DWSU”) provides these same services in the City of Newark using its own equipment which is operated by their properly trained and experienced staff; and
Whereas, the NHA has previously called upon DWSU at various times to respond to these calls for service when their contractor was unable to respond timely; and
Whereas, DWSU maintains operations on a 24 hour per day/7-day per week basis and performs all required sewer services currently provided to the NHA by contractors and is in a position to extend considerable savings to the NHA and now the NHA and the City/DWSU wish to enter into an agreement, pursuant to the Shared Services Act N.J.S.A. 40A:65-l, et seq., whereby DWSU shall respond to all calls for sewer cleaning and inspection services by the NHA, subject to the terms of the Agreement; and
Whereas, the NHA Board of Commissioners adopted Resolution No. H-25-20-02-02 on February 27, 2025 (copy attached), pursuant to the Act authorizing the execution the Shared Services Agreement for the services for the services described herein pursuant to the terms and conditions of the Shared Services Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designees, the Business Administrator and/or the Director of the Department of Water and Sewer Utilities, are authorized to enter into and execute a Shared Service Agreement with the Housing Authority of the City of Newark for the DWSU to provide emergency service response for Sewer Vactor Jet/Rodder for sewer main backups; perform routine sewer inspection services; and conduct quarterly preventative maintenance at various Newark Housing Authority.
2. The initial one year term shall commence upon the approval of this authorizing resolution with an option to renew for year 2 at the discretion of the Newark Housing Authority.
3. The total not to exceed amount for the agreement year 1 is $255,000.00 and optional year 2 is not to exceed $255,000.00 for an aggregate not to exceed amount of $510,000.00.
4. The Director of the Department of Water and Sewer Utilities and/or the Manager of Sewers and Water Supply are authorized to invoice and accept payment for the services provided by the DWSU as more fully set forth in the Shared Services Agreement. Payments received for services provided shall be deposited in the DWSU’s Sewer Utility Operating Account: [B2-Budget Operation Sewer NW038 000 0000 49800.]
5. Pursuant to N.J.S.A. 40A:65-4(b), the Business Administrator and/or the Director of the Department of Water and Sewer Utilities shall file with the City Clerk and the Division of Local Government Services in the New Jersey Department of Community Affairs a copy of the executed Shared Services Agreement.
STATEMENT
Resolution authorizing the Mayor of the City of Newark and/or his designees, the Business Administrator and/or the Director of the Department of Water and Sewer Utilities to enter into and execute a Shared Service Agreement with the Housing Authority of the City of Newark for the DWSU to provide emergency service response for sewer main backups; perform routine sewer inspection services; and conduct quarterly preventative maintenance at various Newark Housing Authority for one year commencing upon Municipal Council approval of this authorizing resolution and NHA option to renew for year two. Total two year aggregate cost to the NHA not to exceed $510,000.00.
