WHEREAS, the State of New Jersey Department of Transportation ("NJDOT") State Aid to Counties and Municipalities FY2015 Bikeways State Aid Program provides grant funding for bicycle lane projects; and
 
WHEREAS, the City of Newark wants to improve access to transit for bicyclists by creating a protected bike lane connecting Penn Station and Broad Street Station in the City of Newark; and
 
      WHEREAS, the City of Newark desires to further the public interest by obtaining funding from the NJDOT State Aid to Counties and Municipalities FY 2015 Bikeways State Aid Program for construction of the Greenway Bike Route, Downtown Transit Connector in the City of Newark; and
 
      WHEREAS, on September 24, 2014, on behalf of the City of Newark, the Director of the Department of Engineering submitted an application to NJDOT requesting grant funding in the amount of $415,500.00 from the NJDOT State Aid to Counties and Municipalities FY 2015 Bikeways State Aid Program for construction of the Greenway Bike Route, Downtown Transit Connector in the City of Newark, identified as application BIKE-2015-Greenway Bike Route, Downtown Tran-00032, with no City funds required; and
 
WHEREAS, as a result of this application, on May 6, 2015, the City of Newark received notice (a copy of the NJDOT grant award letter is attached hereto and made a part hereof) that it has been awarded a grant in the amount of $332,000.00 from the NJDOT State Aid to Counties and Municipalities FY 2015 Local Aid Bikeway Program for construction of the Greenway Bike Route, Downtown Transit Connector Project in the City of Newark, identified as application BIKE-2015-Greenway Bike Route, Downtown Tran-00032, with no City funds required; and
 
      WHEREAS, the City must execute a grant agreement with NJDOT in order to obtain the grant award with no City funds required.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
    1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to submit an application to the New Jersey Department of Transportation ("NJDOT") requesting grant funding in the amount of $415,500.00 from the NJDOT State Aid to Counties and Municipalities FY 2015 Bikeways State Aid Program for construction of the Greenway Bike Route, Downtown Transit Connector in the City of Newark, identified as application BIKE-2015-Greenway Bike Route, Downtown Tran-00032, with no City funds required.  (a copy of the application is attached hereto and made a part hereof).
    1. The Municipal Council hereby ratifies its authorization of this application from September 24, 2014 to the date of adoption of this authorizing resolution.
    2. The grant award in the amount of $332,000.00 from the NJDOT FY 2015 Local Aid Bikeway Program for construction of the Greenway Bike Route, Downtown Transit Connector Project in the City of Newark, is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).
    1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the NJDOT to receive and expend the grant award in the amount of $332,000.00 from the NJDOT FY 2015 Local Aid Bikeway Program for construction of the Greenway Bike Route, Downtown Transit Connector Project in the City of Newark.
    1. The agreement between the City of Newark and the NJDOT is hereby ratified from the start date of the agreement to the date of adoption of this authorizing resolution.
    2. Upon notification of final authorization of this project, the Director of the Department of Engineering shall submit a complete copy of the grant/project agreement and any associated documents to both the Corporation Counsel and the Business Administrator for review, approval, and signature.
    3. No municipal funds are required for receipt or acceptance of this grant award.
    1. The Director of Department of Engineering shall file a fully-executed copy of the grant application, grant award letter, and grant agreement in the Office of City Clerk.
 
STATEMENT
 
This resolution ratifies and authorizes the actions taken by the Mayor and/or his designees, the Director of the Department of Engineering to submit an application to the New Jersey Department of Transportation ("NJDOT") requesting grant funding in the amount of $415,500.00 from the NJDOT State Aid to Counties and Municipalities FY 2015 Bikeways State Aid Program for construction of the Greenway Bike Route, Downtown Transit Connector in the City of Newark, identified as application BIKE-2015-Greenway Bike Route, Downtown Tran-00032, and furthermore, ratifies and authorizes the Mayor and/or his designees, the Director of the Department of Engineering to enter into and execute an agreement with and accept grant funds in the amount of $332,000.00 from the NJDOT FY 2015 Local Aid Bikeway Program for construction of the Greenway Bike Route, Downtown Transit Connector Project in the City of Newark with no City funds are required.
