This resolution rescinds Resolution 7R11-a(S/A) adopted on June 22, 2021, and all agreements authorized by the same, and authorizes an Application/Acceptance for Grant Funding to develop Broadway Park.

WHEREAS, the State of New Jersey Department of Environmental Protection, Green Acres Program, Urban Parks Grant (the “State”), provides loans and/or grants to municipal and county governments and grants to promote urban parks; and
WHEREAS, the City of Newark (the “City”) desires to further the public interest by developing a new city park by developing Broadway Park; and
WHEREAS, The Trust for Public Land (“TPL”), a nonprofit organization dedicated to conserving land and developing parks for recreation and open space is partnered with the City to design and develop Broadway Park, and will concurrently conduct participatory design at nearby Luis Munoz Elementary School and Elliott Street School, hold community meetings, and engage a landscape architect on the design and development of Broadway Park and surrounding schoolyards as a community resource; and
WHEREAS, on June 22, 2021, the Municipal Council adopted Resolution 7R11-a(S/A), which authorized the Mayor and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services to accept grant funds in the amount of $500,000.00 from the State, with a municipal funds match of $500,000.00; and
WHEREAS, pursuant to the State, fifteen (15) days’ notice is required to ensure opportunity for public comment, which inadvertently did not occur; and
WHEREAS, following adoption of Resolution 7R11-a(S/A) June 22, 2021, the City was notified no matching funds are required; and
WHEREAS, the City wishes to apply for and accept grant funding through the State for the development of Broadway Park, in the estimated amount of Five Hundred Thousand Dollars and Zero Cents ($500,000.00), with no municipal funds required; and
WHEREAS, the State shall determine if the application is complete and in conformance with the scope and intent of the Green Acres Program, Urban Parks Grant and notify the City of the amount of the funding award; and
WHEREAS, the City will use the State’s funds in accordance with applicable rules, regulations and statutes, and is willing to enter into an agreement with the State for the above-named project; and
WHEREAS, in the event the State’s funds are less than the total project cost of approximately $4,000,000.00 to $6,000,000.00, the City has the balance of funding necessary to complete the project; and
WHEREAS, upon notification of the receipt of the grant award in connection with this application, the Mayor and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services desires to accept the grant award and execute a grant agreement governing said award; and
WHEREAS, upon notification of the receipt of the grant award in connection with this application, the Mayor and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services shall submit a copy of the grant agreement to the Corporation Counsel and Business Administrator for review, approval, and signature.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council rescinds Resolution 7R11-a(S/A) adopted on June 22, 2021.
2. This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services, to: (a) submit an application to the State of New Jersey Department of Environmental Protection, Green Acres Program, Urban Parks for grant funds for the development of Broadway Park; (b) provide additional application information and furnish such documents as may be required; and (c) act as the authorized correspondent for the City of Newark in its application.
3. The Municipal Council hereby authorizes the Mayor and/or his designee(s), Director of the Department of Recreation, Cultural Affairs and Senior Services, to apply for and accept any grant funding from the State of New Jersey Department of Environmental Protection, Green Acres Program, Urban Parks Grant, for this project, without requiring Municipal Council approval.
4. Upon notification of receipt of the State grant award in connection with this application, the grant is hereby accepted.
5. Upon notification of receipt of the State grant award in connection with this application, The Mayor and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services, are hereby authorized to execute an agreement and any amendment thereto with the State known as The Broadway Park Project, to receive and expend the grant award for the purpose of the development of Broadway Park.
6. Upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Recreation, Cultural Affairs and Senior Services shall submit a complete copy of the grant agreement, any amendment thereto, and any associated documents to both the Corporation Counsel and the Business Administrator for review, approval, and signature.
7. The Municipal Council ratifies its authorization from June 22, 2021 to the date of adoption of this authorizing resolution.
8. The City of Newark agrees to comply with all applicable federal, state, and local laws, rules and regulations in its performance of the project.
9. No municipal funds are required for receipt or acceptance of this grant award.
10. A copy of the fully executed grant agreement and all attachments, shall be filed in the Office of the City Clerk and made available for public inspection.

This Resolution rescinds Resolution 7R11-a(S/A), adopted on June 22, 2021, and ratifies and authorizes the Mayor and/or his designee(s), the Director of the Department of Recreation, Cultural Affairs and Senior Services, to submit an application for, accept, and enter into, an agreement for funding in the approximate amount of $500,000.00 from the State of New Jersey Department of Environmental Protection, Green Acres Program, Urban Parks Grant to develop Broadway Park. No municipal funds are required for receipt or acceptance of this grant award.
