WHEREAS, on August 16, 2017 the City of Newark through its Supervising Procurement Specialist, QPA, advertisement to solicit bids for contractor(s) to provide a 2017 or Newer Ford F-250 King Cab Pickup Truck with Snow Plow to the Department of Public Works, Division of Sanitation as per the bid proposal attached hereto; and
WHEREAS, the Division of Central Purchasing also distributed eight (8) bid proposal packages to the prospective vendors following the date of advertisement; and
WHEREAS, on August 31, 2017, the Division of Central Purchasing received no bids in response to this advertisement; and
WHEREAS, on September 19, 2017 the City of Newark, through its Supervising Procurement Specialist, QPA, issued a second advertisement to solicit bids for contractor(s) to provide a 2017 or Newer Ford F-250 King Cab Pickup Truck with Snow Plow to the Department of Public Works, Division of Sanitation, as per the bid proposal attached hereto; and
WHEREAS, on October 3, 2017, the City of Newark, through its Supervising Procurement Specialist, QPA, issued addendum #1 revising the bid specifications and changing the type of vehicle from a King Cab to a Crew Cab, 2017 Newer Ford F-250 Crew Cab with 8.5’ Boss Snow Plow and Ford options #473, Snow Plow Prep Package or equivalent; and
WHEREAS, the Division of Central Purchasing distributed eight (8) bid proposal packages to prospective vendors following the October 3, 2017, advertisement; and
WHEREAS, on October 13, 2017, the Division of Central Purchasing received two (2) bids in response to this advertisement; and
WHEREAS, the Director of Public Works recommends that an award be made to the lowest responsive and responsible bidder; Beyer Ford LLC, to provide four (4) 2017 or Newer Ford F-250 Crew Cab with 8.5 Boss Snowplow System Ford options #473 Snow Plow Package or equivalent; and
WHEREAS, the Supervising Procurement Specialist, QPA, concurs with the recommendation by the Department of Public Works, that an award be made to Beyer Ford, LLC, the lowest responsive and responsible bidder; and
WHEREAS, pursuant to N.J.S.A. 40A:11-24 the vendor consented to holding the price bid until June 30, 2018; and
WHEREAS, Maple Crest Ford declined to hold the prices bid for consideration beyond December 31, 2017; and
WHEREAS, pursuant to N.J.S.A.19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1 et seq. meets the requirements of the fair and open process.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/ or his designee, the Supervising Procurement Specialist, QPA, are hereby authorized to enter into a contract with Beyer Ford LLC, 170 Ridgedale Avenue, Morristown, New Jersey 07960, to provide four (4) 2017 or Newer Ford F-250 Crew Cab with 8.5 Boss Snow Plow System and Ford options #473 Snow Plow Prep Package or equivalent, as said vendor was determined to be the lowest responsive, responsible bidder for the trucks as cited, in accordance with bid specifications received on the advertised due date to be established upon complete delivery not to exceed December 31, 2018.
2. There shall be no amendment or change of this contract without the approval of the Newark Municipal Council by resolution.
3. Funds for these acquisitions are encumbered on Purchase Order NW045, 0000002547 Fund 045, Dept. 17G, Division/Project 17A18, Account, 94710, Budget Reference B2017 for $140,496.00.
4. The Supervising Procurement Specialist, QPA, shall file a copy the Purchase Order(s) which is the contract pursuant to N.J.S.A.40A:11-2 (21).
5. If required by the State Law, the City Clerk shall provide the appropriate notice of the award of this contract, to the State Comptroller no later than twenty (20) business days following such award in accordance with N.J.S.A. 52: 15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Supervising Procurement Specialist, QPA, to enter into a contract with Beyer Ford LLC, to provide four (4) 2017 or Newer Ford F-250 Crew Cab with 8.5 Boss Snow System and Ford options #473 Snow Plow Prep Package, or equivalent, to the City of Newark at a cost not to exceed $140,496.00, upon complete delivery not to exceed December 31, 2018.
