Additional Information:  
There was a previous bid solicitation in this matter in which two (2) bid packages were distributed and one (1) bid was received, but said bid was rejected because it was deemed to be unresponsive.  Accordingly, this contract is being awarded pursuant to a second bid solicitation in which three (3) bid packages were distributed, and one (1) bid was received.
The contract being awarded is also being ratified from December 1, 2013, to the date of adoption of this resolution.

WHEREAS, the City of Newark advertised Contract to Service and Maintain Control System at the City of Newark's Pequannock Water Treatment Plant, on September 10, 2013; and
 
WHEREAS, the Department of Water and Sewer Utilities distributed two (2) bid packages to prospective vendors following the date of advertisement; and
 
WHEREAS, on September 25, 2013, one (1) bid was received for the said project, but said bid was deemed to be unresponsive and therefore rejected; and
 
WHEREAS, the City of Newark re-advertised Contract to Service and Maintain Control System at the City of Newark's Pequannock Water Treatment Plant, on October 30, 2013; and
 
WHEREAS, the Department of Water and Sewer Utilities distributed three (3) bid packages to prospective vendors following the date of re-advertisement; and
 
WHEREAS, on November 13, 2013, one (1) bid was received for the said project in  accordance with  the Local Public Contracts Law N.J.S.A. 40A:11-1 et seq., and
 
 
WHEREAS, ABB, Inc., 29801 Euclid Avenue, Wickliffe, Ohio 44092, submitted the lowest responsive and responsible bid in the amounts of
 
·      $28,431.60 for 120 hours of Annual Service and preventive maintenance;
 
·      $8,672.40 for Annual Technical Support, according to the bid specifications; and
 
·      labor price of $236.93 per additional service hours and replacement parts price discounts (for which the Department of Water and Sewer Utilities anticipates additional service, and parts replacement for Control System Maintenance in an amount not to exceed $24,000.00); and
 
WHEREAS,      the City of Newark wishes to accept the bid submitted by ABB, Inc., on November 13, 2013, and execute Contract to Service and Maintain Control System at the Pequannock Water Treatment Plant, with ABB, Inc., 29801 Euclid Avenue, Wickliffe, Ohio 44092, for an amount of $28,431.60 for 120 hours of Annual Service and $8,672.40 for annual Technical Support and an amount not to exceed $24,000.00 for estimated additional service and Parts Replacement, for a combined total contract amount not to exceed $61,104.00.  
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
  1. The Municipal Council hereby authorizes the Mayor and/or his designee, the Acting Director of  the Department of Water and Sewer Utilities, to accept the lowest responsive and responsible bid submitted on November 13, 2013 by ABB, Inc., and execute a Contract to Service and Maintain Control System at the City of Newark's Pequannock Water Treatment Plant with ABB, Inc., 29801 Euclid Avenue, Wickliffe, Ohio 44092, for an amount of $28,431.60 for 120 hours of Annual Service and $8,672.40 for annual Technical Support and an amount not to exceed $24,000.00 for estimated additional service and Parts Replacement, for a combined total contract amount not to exceed $61,104.00.
  2. This contract shall be for a period not to exceed one year, commencing on December 1, 2013 and ending on November 30, 2014.
  3. The contract is hereby ratified from December 1, 2013, to the date of adoption of this resolution.
  4. Pursuant to N.J.A.C. 5:30-5.5, attached hereto is a partial certification of funds from the Acting Director of Finance which states that funds in the amount of $10,000.00 are available in the 2013 Budget under Business Unit: NW037, Department ID: 750, Division: 7502, Account: 71770, Budget Ref.: B2013. The certification shall be filed along with the original resolution in the Office of the City Clerk. The remainder of the funding for this contract will be subject to appropriation in the 2013 and 2014 Budget and included in a line item for the award of this contract and said funds will be certified prior to services being provided by the contractor.  There will be no expenditure of funds authorized until a Certification of Funds is obtained and a copy filed with the City Clerk.
  5. There shall be no amendment or change to the contract without approval by the Newark Municipal Council.
  6. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.
  7. A fully executed copy of the contract shall be filed in the Office of the City Clerk by the Acting Director of the Department of Water and Sewer Utilities.
  8. This contract was solicited and awarded through a fair and open process in accordance with N.J.S.A. 19:44A-20.5.
  9. If required by State Law, the City Clerk shall provide the appropriate Notice of the Award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

This resolution authorizes the Mayor and/or his designee, the Acting Director of the Department of Water and Sewer Utilities, to accept the lowest responsive and responsible bid submitted on November 13, 2013 by ABB, Inc., and execute Contract to Service and Maintain Control System at the City of Newark's Pequannock Water Treatment Plant with ABB, Inc., 29801 Euclid Avenue, Wickliffe, Ohio 44092, for an amount of $28,431.60 for 120 hours of annual Service and $8,672.40 for annual Technical Support and an amount not to exceed $24,000.00 for estimated additional service and Parts Replacement, for a combined total contract amount not to exceed $61,104.00, for a period from December 1, 2013 up to November 30, 2014, and ratifying the period from December 1, 2013 up to the date the contract is authorized.
