Apply and Accept Resolution 7R5-s, adopted on June 7, 2023, accepted a grant award in the amount of $418,900.00, for the period of January 1, 2023 through December 31, 2023.
The Department of Health and Community Wellness wishes to execute a no cost extension of the Grant Agreement, for the grant period of January 1, 2023 through June 30, 2024, from the State of New Jersey Department of Community Affairs’ Lead Grant Assistance Program.

WHEREAS, effective July 22, 2022, the Legislature enacted P.L. 2021, c. 182, “An Act concerning certain lead-based paint hazard, and residential rental property, and establishing lead-based paint hazard programs, supplementing P.L. 2003, c. 311 (C. 52:27D-437.1 et al.) amending various parts of the statutory law, and making an appropriation”; and
WHEREAS, pursuant to N.J.S.A. 52:27D-437.16(b)(1), a municipality that maintains a permanent local agency for the purpose of conducting inspections and enforcing laws, ordinances, and regulations concerning buildings and structures, is required to inspect for lead-based paint hazards in certain specified single-family, two-family, and multiple rental dwellings, at the time periods set forth in the statute; and
WHEREAS, the Division of Local Government Services (“DLGS”) within the State of New Jersey Department of Community Affairs (“DCA”) administers the Lead Grant Assistance Program (“LGAP”); and
WHEREAS, the LGAP provides funding to municipalities help off-set the costs to provide required inspections of certain single-family, two-family, and multiple rental dwelling units for lead-based paint hazards, pursuant to P.L. 2021, c. 182; and
WHEREAS, the City of Newark (the “City”), Department of Health and Community Wellness (“DHCW”) desires to receive funding from the DCA for the aforementioned purpose; and
WHEREAS, the City’s DHCW was awarded funding in the amount of Four Hundred Eighteen Thousand Nine Hundred Dollars and Zero Cents ($418,900.00) from the DCA for the period commencing on January 1, 2023 and terminating on December 31, 2023; and
WHEREAS, on December 26, 2023, the DCA amended the award letter providing a no cost extension for the period of January 1, 2023 through June 30, 2024; and
WHEREAS, the City’s DHCW desires to accept the no cost extension of the grant award for the period commencing on January 1, 2023 and terminating on June 30, 2024; and
WHEREAS, the Director of the DHCW must enter into and execute the Lead Grant Assistance Program Agreement (attached hereto) to receive LGAP funding.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to accept a no cost extension and execute the Lead Grant Assistance Program (“LGAP”) Agreement, attached hereto, from the State of New Jersey Department of Community Affairs, Division of Local Government Services (“DCA”), 101 South Broad Street, Trenton, New Jersey 08625, for the period commencing January 1, 2023 and terminating June 30, 2024, for the purpose of assisting the City of Newark of cost of certain Lead Inspections.
2. The Municipal Council hereby ratifies its authorization of this grant application from the date of January 1, 2023 to the date of adoption of this authorizing Resolution.
3. The Mayor of the City of Newark and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to expend the amount of the grant award from the DCA for the period of January 1, 2023 through June 30, 2024, a copy of the Agreement is attached and made a part hereto.
4. The Director of the Department of Health and Community Wellness shall file a fully executed copy of the grant application and notice of grant award in the Office of the City Clerk.
5. This Resolution shall take effect immediately.
6. All other terms and conditions of the Agreement remain the same.
STATEMENT
This Resolution ratifies and authorizes the actions taken by the Mayor of the City of Newark and/or his designee, the Director of the Department of Health and Community Wellness, to execute a no cost extension for the grant period of January 1, 2023 through June 30, 2024, from the State of New Jersey Department of Community Affairs’ Lead Grant Assistance Program, in the amount of Four Hundred Eighteen Thousand Nine Hundred Dollars and Zero Cents ($418,900.00). The funding shall off-set the cost to the City of Newark to provide required inspections for certain single-family, two-family, and multiple rental dwellings units for lead - based paint hazards, pursuant to P.L. 2021, c.182, for the period commencing January 1, 2023 and terminating June 30, 2024. No Municipal funds are required for receipt of acceptance of the award.
