WHEREAS, the Clean Communities Act, N.J.S.A. 13:1E-217 et seq. (“Act”), established a grant fund, entitled the “Clean Communities Entitlement Program” and administered by the New Jersey Department of Environmental Protection (“NJDEP”), from which grants may be made to municipalities in order to encourage increased anti-litter campaigns; and

 

WHEREAS, the City of Newark is eligible, without application, to receive an annual grant under the Act to create or to supplement an existing litter reduction program within the municipality; and

 

WHEREAS, the City of Newark desires to further the public interest by obtaining funding from the “Clean Communities Entitlement Program” with the intent of the Act is to use the grants to develop new municipal anti-litter programs and to continue and expand existing programs; and

 

WHEREAS, in order to receive Clean Communities Entitlement Program funds, municipalities are required to plan and implement a program which combines the elements of litter clean-up and removal, enforcement of litter related laws and ordinances, litter abatement, public information and education, and encourage the proper handling of solid waste; and

 

WHEREAS, the City of Newark has implemented such a program; and

 

WHEREAS, it is the desire of the City of Newark to continue said program in order to provide a clean, litter free environment for its citizens; and

 

WHEREAS, the Clean Communities Entitlement Program does not require a grant application or NJDEP approval in order to obtain a grant award; and

 

WHEREAS, the City of Newark has been awarded a grant in the amount of $494,289.11 from the Clean Communities Entitlement Program for programs of litter pick up and removal as well as for abatement of graffiti, for the period commencing on January 1, 2016  and terminating on June 30, 2017, with no expenditure of City funds or resources required

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The acceptance of the grant award in the amount of $494,289.11 from the Clean Communities Entitlement Program (a copy of the check is attached hereto and made a part hereof) is hereby authorized and ratified from May 11, 2016 until the date of adoption of this authorizing resolution.

 

2.                     The Mayor and/or his designee, the Director of the Department of Public Works, are hereby authorized to enter into and execute such grant documents as required to receive and expend the grant award in the amount of $494,289.11 for programs of litter pickup and removal as well as for abatement of graffiti, for the period commencing January 1, 2016 and terminating on June 30, 2017 (a copy of the Clean Communities Entitlement Program Fact Sheet is attached hereto and made a part hereof).

 

3.                     The Municipal Council hereby ratifies its authorization to execute such grant documents from the date of their submission to the date of adoption of this authorizing Resolution.

 

4.                     The Department of Public Works will be responsible for the Clean Community Program’s implementation, and the Director of the Department of Public Works is hereby designated as the Clean Community Coordinator.

 

5.                     No municipal funds are required for receipt or acceptance of the grant award.

 

6.                     The Director of the Department of Public Works shall file a fully executed copy of the grant award letter, the grant agreement, and any other associated grant documentation in the Office of the City Clerk.

 

 

 

 

 

STATEMENT

 

This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Public Works, to enter into and execute an agreement for the acceptance of grant funds in the amount of $494,289.11 from the Clean Communities Entitlement Program for programs of litter pick up and removal as well as for abatement of graffiti, for the period commencing January 1, 2016 and terminating on June 30, 2017.  No municipal funds are required for the receipt or acceptance of the grant award.
