WHEREAS, on April 5, 2023, the Newark Municipal Council adopted Resolution 7R5-b, ratifying and authorizing the execution an Award Agreement from the New Jersey Association of County and City Health Officials (NJACCHO), P.O. Box 6987, Freehold, New Jersey 07728 for a reimbursement grant , in the amount up to $3,863,002.00, for Local Health Department (LHD) expenses directly related to the COVID-19 pandemic and to build local public health infrastructure capacity to better prepare and respond to emerging infectious diseases, for the period commencing on October 1, 2022 through June 30; and
WHEREAS, pursuant to Resolution7R5-a, adopted on October 18, 2023 (“Amending Resolution”), the City of Newark (the “City”) executed and entered into an Agreement with NJACCHO, , for a Grant Award increase of Three Million Eight Hundred and Twenty Six Thousand Nine Hundred Twenty Five Dollars and Zero Cents ($3,826,925.00) for a total Grant Award in the amount of Seven Million Six Hundred Eighty-Nine Thousand Nine Hundred Twenty-Seven Dollars and Zero Cents ($7,689,927.00), for Local Health Department (LHD) expenses directly related to the COVID-19 pandemic and to build local public health infrastructure capacity to better prepare and respond to emerging infectious diseases and a no cost extension through June 30, 2025; and
WHEREAS, the Grant Agreement for the increase pursuant to the Amending Resolution was executed on or about August 9, 2023; and
WHEREAS, on June 13, 2025 the NJACCHO amended the Award Letter to extend the Grant period commencing October 1, 2022 and terminating on March 31, 2026, to provide for Local Health Department (LHD) expenses directly related to the COVID-19 pandemic and to build local public health infrastructure capacity to better prepare and respond to emerging infectious diseases; and
WHEREAS, the City, desires to accept the no cost extension for the period of October 1, 2022 through March 31, 2026, from NJACCHO for Local Health Department (LHD) expenses directly related to the COVID-19 pandemic and to build local public health infrastructure capacity to better prepare and respond to emerging infectious diseases; and
WHEREAS, the amended Grant Agreement for the no cost extension was executed on or about July 1, 2025; and
WHEREAS, the City’s, Department of Health and Community Wellness (“DHCW”) has expended and continues to expend funds to provide Local Health Department (“LHD”) related services during the ongoing COVID-19 Public Health Emergency and pandemic; and
WHEREAS, NJACCHO agrees to reimburse DHCW retroactively, from October 1, 2022 through March 31, 2026, for LHD related expenses and continue such reimbursement until the Contract termination date of March 31, 2026; and
WHEREAS, all other terms and conditions of the Grant Agreement and Resolution 7R5-a adopted on October 18, 2023 shall remain the same.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to accept and enter into a Grant Amendment for the no cost extension for the grant period commencing October 1, 2022 and terminating on March 31, 2026, from the New Jersey Association of County and City Health Officials (NJACCHO), P.O. Box 6987, Freehold, New Jersey 07728, (a copy of the Letter of Agreement is attached hereto and made a part hereof).
2. The Municipal Council hereby ratifies the acceptance and execution of the Grant Agreement from June 13, 2025 to the date of the adoption of this authorizing Resolution.
3. The Grant period for the Grant Award in the total amount of Seven Million Six Hundred Eighty-Nine Thousand Nine Hundred Twenty-Seven Dollars and Zero Cents ($7,689,927.00), from the New Jersey Association of County and City Health Officials (NJACCHO), is hereby extended.
4. Resolution 7R5-a October 18,2023 is amended to the extent it is inconsistent with this Resolution. All other terms and conditions of Resolution 7R5-a adopted on October 18,2023 and the original Grant Agreement shall remain in full force and effect.
5. This Resolution shall take effect immediately.
6. The Director of the Department of Health and Community Wellness shall file a copy of this Resolution and a fully executed copy of the Grant Agreement with the office of the City Clerk.
7. No municipal funds are required for receipt or acceptance of this Grant Award extension.
STATEMENT
This Resolution authorizes an amendment of the Grant Award from the New Jersey Association of County and City Health Officials (NJACCHO), P.O. Box 6987, Freehold, New Jersey 07728, and further authorizes and ratifies the actions taken by the Mayor of the City of Newark and/or his designee, the Director of the Department of Health and Community Wellness, to enter into and execute a no-cost extension of the Grant period, commencing on October 1, 2022, and terminating on March 31, 2026 to support the reimbursement of Local Health Department (LHD) expenses directly related to the COVID-19 pandemic, as well as efforts to strengthen local public health infrastructure to enhance preparedness and response to emerging infectious diseases. The acceptance of NJACCHO COVID-19 reimbursement funds does not require the expenditure of any municipal funds.
