WHEREAS, on May 26, 2016, the Newark Municipal Council ratified and authorized from April 2016, the Mayor, and/or his designee, the Director of the Department of Neighborhood and Recreational Services to enter into, a contract with Forest Lodge Catering, LLC, also known as Forest Lodge, LLC, 11 Reinman Road, Warren, New Jersey 07059-5121, for the July 9, 2016 use of facilities and amenities by, as well as the provision of food and refreshments for, Newark residents and their families for a one day, outdoor, City outing in a wholesome and nurturing environment, which promulgated the event slogan and title, “Celebrate Newark Families Day with the Mayor and the Newark Municipal Council” and “Newark Family Day”, respectively; and
WHEREAS, the contract entered into by the City of Newark and Forest Lodge Catering, LLC was based upon per participant pricing and required payment of a deposit in the amount of Ninety Thousand Dollars and Zero Cents ($90,000.00);
WHEREAS, it was anticipated that the total cost of the event would not greatly exceed the deposit payment amount of Ninety Thousand Dollars and Zero Cents ($90,000.00); and
WHEREAS, pursuant to 7R10-a May 26, 2016, the City of Newark paid to Forest Lodge Catering, LLC the contract deposit amount of Ninety Thousand Dollars and Zero Cents ($90,000.00) in relation to the Newark Family Day event; and
WHEREAS, subsequent to the July 9, 2016 Newark Family Day event, Forest Lodge, LLC presented to the City of Newark an invoice which includes charges for entertainment, amusement packages in the amount of Ninety-Six Thousand Six Hundred Sixty-Five Dollars and Twenty-Seven Cents ($96,665.27); and
WHEREAS, although prior to the event, the Administration was not made aware of these additional entertainment, amusement package provisions, the entertainment, amusement packages were provided to, and were received by, the City of Newark, (by way of Newark residents and their families,) on day of event; and
WHEREAS, there is a balance due Forest Lodge, LLC in the amount of Ninety-Six Thousand Six Hundred Sixty-Five Dollars and Twenty-Seven Cents ($96,665.27) for the entertainment, amusement packages provided to, and received by, the City of Newark, (by way of Newark residents and their families,) as identified in the attached supporting documentation; and
WHEREAS, the Mayor and the Director of the Department of Neighborhood and Recreational Services believe it is in the best interests of the City to pay the money owed for said entertainment, amusement package costs to Forest Lodge, LLC, 11 Reinman Road, Warren, New Jersey 07059-5121, in an amount not to exceed Ninety-Six Thousand Six Hundred Sixty-Five Dollars and Twenty-Seven Cents ($96,665.27)
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Neighborhood and Recreational Services, are hereby authorized to pay to Forest Lodge, LLC, 11 Reinman Road, Warren, New Jersey 07059-5121, an amount not to exceed Ninety-Six Thousand Six Hundred Sixty-Five Dollars and Twenty-Seven Cents ($96,665.27) for entertainment, amusement packages provided to, and received by, the City of Newark, (by way of Newark residents and their families,) at the July 9, 2016 Newark Family Day event.
2. Attached hereto is a Certification of Funds from the Municipal Comptroller as to the availability of sufficient funds.
3. A copy of all relevant documents and the Certification of Funds shall all be filed in the Office of the City Clerk by the Director of the Department of Neighborhood and Recreational Services.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Director of the Department of Neighborhood and Recreational Services, to pay Forest Lodge, LLC, 11 Reinman Road, Warren, New Jersey 07059-5121, the exact amount of Ninety-Six Thousand Six Hundred Sixty-Five Dollars and Twenty-Seven Cents ($96,665.27) for the entertainment, amusement packages provided to, and received by, the City of Newark, (by way of Newark residents and their families,) at the July 9, 2016 Family Fund Day event.
