WHEREAS, the City of Newark, 920 Mayor Kenneth A. Gibson Boulevard, Newark, New Jersey 07102 (the “City”) owns property located at 2047 Route 23 North, West Milford Township, New Jersey, designated as Block 14103, Lot 1; and
WHEREAS, the New Jersey Department of Transportation (“State” or “NJDOT”) intends to: [i] construct a retaining wall; [ii] construct subsurface drains, a drainage outfall with rip-rap apron and appurtenances; and [iii] remove and abandon aerial Verizon cables and other related work at Route 23 Northbound from High Crest Drive to Macopin River located in West Milford Township located in Passaic County (hereinafter called the “Project”); and
WHEREAS, in the attached NJDOT project documents the State identified and refers to the property as Route 23, Section 4, Parcel E51A, E51B, E51C (“the City’s property”); and
WHEREAS, the Project requires a Temporary Construction Easement Agreement for the City’s property; and
WHEREAS, the State will compensate the City the amount of One Thousand Dollars and Zero Cents ($1,000.00) for use of the identified property; and
WHEREAS, the State and City desire to enter into and execute a Temporary Construction Easement Agreement for access to the City property described in the Schedule A and depicted in the Exhibit B Map (hereto attached).
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, are authorized on behalf of the City of Newark to enter into a Temporary Construction Easement Agreement and such other necessary documents that may be required with the New Jersey Department of Transportation (NJDOT) for the State construction project on Route 23 High Crest Drive to Macopin River (to: [i] construct a retaining wall; [ii] construct subsurface drains, a drainage outfall with rip-rap apron and appurtenances; and [iii] remove and abandon aerial Verizon cables and other related work) and a property located at 2047 Route 23 North, Section 4, Parcel E51A, E51B, E51C, West Milford Township, New Jersey, Block 14103, Lot 1, for a compensation amount of one thousand dollars and Zero Cents ($1,000.00), for a temporary construction easement period of six (6) months from the date of Notice from the State’s Resident Engineer. Work beyond six months is compensated semi-annually at rate of $83.00 per month.
2. The reimbursement from the State shall be deposited into Department of Water and Sewer Account No. NW038 800 8003 52630 B2025.
3. The Director of Water and Sewer Utilities shall file a fully executed copy of the Agreement in the Office of the City Clerk.
4. No changes shall be made to the terms and conditions of this Agreement without prior Municipal Council approval.
5. No municipal funds are required or will be spent under this Agreement or for this State Project.
STATEMENT
The Resolution authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, to enter into a temporary Construction Easement Agreement with the New Jersey Department of Transportation to: [i] construct a retaining wall; [ii] construct subsurface drains, a drainage outfall with rip-rap apron and appurtenances; and [iii] remove and abandon aerial Verizon cables and other related work at Route 23 Northbound from High Crest Drive to Macopin River located in West Milford Township.
