This resolution will authorize extension of Emergency Contract #E2025-17, initially issued for the period November 01, 2025 through February 01, 2026, and awarded to Sunbelt Temporary Structures 80 Arlington Avenue Kearny NJ, 07032, for an amount not to exceed $238,620.00.
This current Resolution of Emergency Contract #E2025-17 extends the contract for second ninety- (90) day period from May 01, 2026 until August 01, 2026. This Resolution combines the first and second request for an extension, effectively extending emergency contract #E2025-17 for one hundred eighty (180) days through August 01, 2026. The emergency repairs are anticipated to be complete by May 30, 2026.

WHEREAS, on October 27, 2025 the Director of the Department Public Safety (“Department”) requested a declaration of emergency for structural repairs to the bay floor area of the Newark Fire Division’s Engine 19 Firehouse, which repairs were needed to alleviate safety concerns for fire department personnel, to avoid permanent, weather damage to the fire apparatus which, absent the repairs, would have to be stationed outdoors, and to permit fire fighters to respond timely to emergencies; and
WHEREAS, therefore, on November 01, 2025, pursuant to N.J.S.A. 40A:11-6 and N.J.A.C. 5:34-6.1(a), the Qualified Purchasing Agent, QPA, declared an emergency and authorized Emergency Contract # E2025-17 with Sunbelt Temporary Structures, 80 Arlington Avenue, Kearny, New Jersey 07032, for a not-to-exceed contract amount of Two Hundred Thirty-Eight Thousand Six Hundred Twenty Dollars and Zero Cents ($238,620.00); and
WHEREAS, On February 19, 2026, the Director requested an extension of emergency contract #E2025-17 for the emergency repairs to the bay floor area of the Engine 19 Firehouse; and
WHEREAS, the Qualified Purchasing Agent is satisfied that the emergency continues to exist, notwithstanding the good faith efforts of the Department; and
WHEREAS, City Ordinance 6PSF-e adopted April 6, 2011 limits the period of emergency contracts to ninety (90) days and permits extensions only with the authorization of the Municipal Council.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The extension of Emergency Contract #E2025-17 with Sunbelt Temporary Structures 80 Arlington Avenue, Kearny NJ 07032, for the immediate temporary abatement to the repairs needed on the bay floor area of Engine 19’s firehouse is hereby extended for two ninety-day (90-day) periods from February 01, 2026 to August 01, 2026.
2. This emergency contract extension is ratified back to February 01, 2026 through the date of adoption of this authorizing resolution.
3. Funds are available under the Department of Engineering budget account code: NW051 G25-71280-F25B0.
4. The Purchasing Agent shall file a copy of Emergency Contract #E2025-17 and any and all documents amending same in the Office of the City Clerk and shall post a copy of the emergency contract and extension on the City of Newark’s website within forty-eight (48) hours.
5. If required by State Law, the City Clerk shall provide the appropriate notice of the award of the contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10.
STATEMENT
This resolution ratifies and authorizes the extension of Emergency Contract #E2025-17 with Sunbelt Temporary Structures, 80 Arlington Avenue Kearny, NJ 07032, for the continued temporary abatement to the repairs needed on the bay floor area of Engine 19’s fire house, which fire apparatus cannot be stationed inside until repaired. The extension is through August 01, 2026, or until completion of the project, for a total not-to-exceed amount of Two Hundred Thirty-Eight Thousand Six Hundred Twenty Dollars and Zero Cents ($238,620.00).
