The budget was changed to reflect the indirect cost associated with the project and anticipated by the City of Newark. The indirect cost utilizes the federal de minimis rate of 15% to recover cost associated with the project. The indirect cost associated with the project is applied to the local match.

WHEREAS, the Federal Highway Administration (FHWA) provides grant funding through the Safe Streets and Roads for All ("SSRFA") Program to support planning, infrastructure, and behavioral and operational initiatives to prevent death and serious injury on roads and streets involving all roadway users; and
WHEREAS, on February 05, 2025, the Municipal Council adopted Resolution 7R3-a ("Resolution 7R3-a 02/05/2025") authorizing City of Newark ("City") officials to apply for SSRFA funding and to accept a SSRFA grant award in the amount of Eight Hundred Thousand Dollars and Zero Cents ($800,000.00), with a Two-Hundred-Thousand-Dollar-and-Zero-Cent ($200,000.00) cash match from the City; and
WHEREAS, Resolution 7R3-a 02/05/2025 further authorized City officials to execute a grant agreement with the FHWA , which grant agreement initially provided for a Two-Hundred-Thousand-Dollars-and-Zero-Cent ($200,000.00) cash match from the City for the period commencing upon the effective date of the grant award and terminating on July, 29, 2029; and
WHEREAS, the grant agreement was subsequently revised to provide for a reduced City cash match in the amount of One Hundred Twenty-One Thousand Seven Hundred Forty Dollars and Zero Cents ($121,740.00) and a City in-kind match in the amount of Seventy-Eight Thousand Two Hundred Sixty Dollar and Zero Cents ($78,260.00), reflecting a change in the federal indirect cost rate; and
WHEREAS, the revised grant agreement changed the grant performance period to commence as of the effective date of the grant award and to terminate on March 31, 2030.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R3-a 02/05/2025 is hereby amended to reflect that the Two-Hundred-Thousand-Dollar-and-Zero-Cent ($200,000.00) cash match initially required by the City as a condition of receiving the grant funds has been changed to a One Hundred Twenty-One Thousand Seven Hundred Forty Dollars and Zero Cents ($121,740.00) cash match and a (Seventy-Eight Thousand Two Hundred Sixty Dollar and Zero Cents ($78,260.00) in-kind match, reflecting a change in the federal cost recovery ratio. Resolution 7R1-a 02/05/2025 is further amended to reflect a change in the performance period. The amended performance period shall commence as of the effective date of the grant award and terminate on March 31, 2030. All other provisions of Resolution 7R1-a 02/05/2025 shall remain unchanged.
2. The grant agreement which City officials entered into and executed with the Federal Highway Administration (FHWA) dated April 20, 2026 is hereby authorized and ratified, subject to the approval of the Corporation Counsel and the Business Administrator.
3. In accordance with the amendments authorized by this Resolution, a cash match in the amount of One Hundred Twenty-One Thousand Seven Hundred Forty Dollars and Zero Cents ($121,740.00) shall be provided from the Municipal Budget and an in-kind match of Seventy-Eight Thousand Two Hundred Sixty Dollars and Zero Cents ($78,260.00) shall be provided by the Department of Engineering.
4. The Acting Director of the Department of Engineering shall file a fully-executed copy of the grant award letter, the final authorization letter, and the grant/project agreement in the Office of the City Clerk.
STATEMENT
This Resolution ratifies and authorizes the actions taken by the City of Newark ("City"), Department of Engineering to enter into and execute an agreement with, and accept the FY2023 Safe Streets and Roads for All Grant in the amount of $800,000.00 from, the Federal Highway Administration. The grant funds are for the Newark Safe Routes for All Corridors Project, which will aid in the implementation of pedestrian and motorist improvements throughout the City for the period commencing upon contract execution and terminating on March 31, 2030. Matching grant funds in the amount of $121,740.00 cash and $78,260.00 in-kind services will be provided from the City.
