This contract will provide for the sale of obsolete property no longer needed for public use on an on-line auction website, on behalf of the City's Department of Public Works, Division of Motors.

WHEREAS, the City of Newark (the “City”), through its Purchasing Agent, QPA wishes to utilize State Contract #T2581. Auctioneering Services: Internet Auctions to Sell Surplus Property to dispose of obsolete vehicles and equipment by the Department of Public Works, Division of Motors, from an authorized vendor under the New Jersey Cooperative Purchasing Program I-NJCP, pursuant to N.J.A.C. 5:34-7.29; and
WHEREAS, the purchase, of goods/services by local contracting units are authorized by Local Public Contracts Law, N.J.S.A. 40A:11-12; and
WHEREAS, in accordance with N.J.S.A. N.J.S.A. 52:25-16.1 et seq. and N.J.A.C. 5:34-1.7 all Cooperative Purchasing Program participants are responsible for ensuring that the purchase order issued reflects the correct contract item pricing and that payment is processed accordingly. Only the items/services specified in the applicable State Contract(s) may be purchased from the contract vendor(s) of record. Cooperative Purchasing participants assume full responsibility, for all purchase transactions issued through State Contracts, including purchase orders, delivery compliance and payments; and
WHEREAS, the City wishes to utilize State Contract #T2581 Auctioneering Services: Internet Auctions to Sell Surplus Property, awarded to vendor, MUNICIBID, LLC, 395 Circle of Progress Drive, Suite D, Pottstown, Pennsylvania 19464, Master Blanket Purchase Order #19-GNSV1-00696, to be used by the Department of Public Works, Division of Motors, to dispose of obsolete vehicles and equipment through an online auction, upon approval of this Resolution by the Municipal Council through April 30, 2024, inclusive of extensions by the State; and
WHEREAS, usage of this contract will provide for the sale of surplus personal property (attached hereto), with the proceeds from sales of the auction to be deposited into the City's designated financial accounts; and
WHEREAS, the vendor, MUNICIBID, LLC, 395 Circle of Progress Drive, Suite D, Pottstown, Pennsylvania 19464 will be paid a commission percentage from the proceeds of auction sales, pursuant to State Contract #T2581, Auctioneering Services: Internet Auctions to Sell Surplus Property, Master Blanket Purchase Order #19-GNSV1-00696, for the sale of obsolete equipment Citywide; and
WHEREAS, the City and the vendor shall ensure compliance with PL. 2001, c.30, including all provisions of N.J.S.A. 40A:11-36, and compliance with all State and Local law.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Pursuant to N.J.S.A. 40A:11-1 et seq. and N.J.A.C. 5:34-7.29, the Purchasing Agent, QPA is authorized to utilize State Contract #T2581, Auctioneering Services: Internet Auctions to Sell Surplus Property, to be used by the Department of Public Works, Division of Motors, awarded to vendor, MUNICIBID, LLC, 395 Circle of Progress Drive, Suite D, Pottstown, Pennsylvania 19464, under Master Blanket Purchase Order #19-GNSVI00696 to dispose of obsolete vehicles and equipment through an online auction, for the period commencing upon approval of this Resolution by the Municipal Council through April 30, 2024, inclusive of extensions by the State .
2. All purchases, purchase orders and other related documentation shall be in accordance with the relevant State Contract, New Jersey Standard Terms and Conditions, Method of Operation and Third Party Agreement, if applicable, as contained in the State Contract documentations and agreements.
3. There shall be no amendments of this Resolution without the approval of the Municipal Council.
4. The vendor shall be paid a commission percentage from the proceeds of auction sales, pursuant to State Contract #T2581, Auctioneering Services: Internet Auctions to Sell Surplus Property, Master Blanket Purchase Order # 19-GNSV1-00696, for the sale of obsolete equipment citywide.
5. There shall be no advance payment on this State Contract in accordance with N.J.S.A. 40A:5-16.
6. The sales are being conducted pursuant to the Division of Local Government Services’ Local Finance Notice 2008-9. Funds from the sale, through an online action, of obsolete vehicles and equipment, attached hereto as Auction Equipment, by the Department of Public Works, Division of Motors will be deposited into the City's designated financial accounts.
7. This contract complies with Local Pay-to-Play Law, N.J.S.A. 19:44A-20.5, as a State Contract award and constitutes a fair and open procedure.
8. This contract shall comply with P.L. 2001, c.30, including all provisions of N.J.S.A. 40A:11-36, and all state and local laws.
9. The Division of Central Purchasing shall file a duly executed copy of the contract in the Office of the City Clerk, if applicable.
10. If required by State law, the Acting City Clerk shall provide the appropriate Notice of Award of this contract to the State Comptroller, no later than twenty (20) business days following such award in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Purchasing Agent, QPA, to utilize State Contract #T2581, Auctioneering Services: Internet Auctions to Sell Surplus Property, awarded to vendor MUNICIBID, LLC, 395 Circle of Progress Drive, Suite D, Pottstown, Pennsylvania 19464, Master Blanket Purchase Order #19-GNSV1-00696, to be used by the Department of Public Works, Division of Motors, to dispose of obsolete vehicles and equipment, through an online auction, upon approval of this Resolution by the Municipal Council through April 30, 2024. The proceeds from the sale will be deposited into the City of Newark designated financial accounts. The vendor, Municibid, shall be paid from proceeds of the auction sales, pursuant to the State Contract, for the sale of obsolete equipment citywide.
