This resolution ratifies and authorizes an extension of Emergency Contract #E2026-08, awarded to Pro Cops Security, LLC for the continued provision of Armed Security Guard services. Due to a clerical error, the original Emergency Contract Award memorandum and related documentation incorrectly identified the emergency contract period as April 07, 2026 through August 7, 2026 instead of April 07, 2026 to July 06, 2026. A revised Memorandum has been prepared by the Department of Public Safety. which correctly identifies the emergency contract period. This Resolution extends Emergency Contract #E2026-08 from June 30, 2026 through September 29, 2026, which represents the allowable ninety (90) day emergency contract extension period.

WHEREAS, on April 07, 2026, the Department of Public Safety requested emergency procurement for the immediate provision of Armed Security Guard services to provide security and surveillance for City facilities utilized by the Department of Public Safety, Division of Police, and the Department of Surveillance and Prevention, Division of WIC; and
WHEREAS, on April 07, 2026, pursuant to N.J.S.A. 40A:11-6 and N.J.A.C. 5:34-6.1, the Qualified Purchasing Agent approved Emergency Contract #E2026-08 with Pro Cops Security, LLC, 60 Park Place, Suite 1110, Newark, New Jersey 07102 (“Pro Cops Security”), for a contract amount not to exceed Two Million Dollars ($2,000,000.00); and
WHEREAS, the emergency contract became necessary when the publicly bid contract could not be awarded because the lowest bidder failed to furnish the required performance bond and failed to demonstrate compliance with prevailing wage requirements, creating the immediate need to ensure uninterrupted armed security services for the protection of City employees, residents, visitors, and municipal facilities; and
WHEREAS, the Emergency Contract Award memorandum awarding a contract to Pro Cops Security erroneously identified the original emergency contract period as April 07, 2026 through August 07, 2026, instead of April 07, 2026 to July 06, 2026; and
WHEREAS, the Department of Public Safety has therefore prepared a Memorandum requesting an extension of emergency contract #E2026-08 for the period June 30, 2026 through September 29, 2026, which represents the allowable ninety (90) day emergency contract extension period; and
WHEREAS, the City has continued to diligently pursue the formal public bidding process while maintaining uninterrupted armed security services through emergency procurement; and
WHEREAS, N.J.S.A. 40A:11-6 authorizes the award of emergency contracts when an emergency affecting the public health, safety or welfare requires the immediate performance of services; and
WHEREAS, N.J.A.C. 5:34-6.1(a)(3) authorizes emergency purchasing where the need for the services has arisen notwithstanding a good faith effort by the municipality to plan for the procurement; and
WHEREAS, City Ordinance 6PSF-e, adopted April 6, 2011, limits emergency contracts to ninety (90) days and permits extensions only with authorization of the Municipal Council; and
WHEREAS, the continued provision of Armed Security Guard services remains essential to protect the health, safety, and welfare of City employees, residents, visitors, and municipal facilities until the formal procurement process is completed.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council hereby authorizes an extension of Emergency Contract #E2026-08 with Pro Cops Security, LLC, 60 Park Place, Suite 1110, Newark, New Jersey 07102, for the continued provision of Armed Security Guard services for the period June 30, 2026 through September 29, 2026.
2. This emergency contract amendment is ratified back to June 30, 2026 through the date of adoption of this authorizing resolution.
3. Funds are available under Budget Account: NW011-200-2001-71630-B2026.
4. The Purchasing Agent shall file a copy of Emergency Contract #E2026-08, the Correction Memorandum, this amendatory resolution, and all related documents in the Office of the City Clerk and shall post the emergency contract amendment on the City's website within forty-eight (48) hours as required by law.
5. If required by State law, the City Clerk shall provide the appropriate notice of the award to the Office of the State Comptroller no later than twenty (20) business days following such award pursuant to N.J.S.A. 52:15C-10.
