WHEREAS, the City of Newark is the owner of property located at Tax Block 5001.01, Lot 3, also known as the former bed of the Morris Canal; and

 

                     WHEREAS, the Parcels are located beneath the existing elevated ramp from the Pulaski Skyway to Raymond Boulevard near the entrance to the PSE&G substation and Covanta Essex co-generation plant; and

 

                     WHEREAS, the New Jersey Department of Transportation (NJDOT) desires to acquire a portion of said lot and associated easements from the City of Newark for the completion of the Pulaski Skyway rehabilitation project by purchasing the portion and associated easements by private sale for the appraised value of Sixteen Thousand, Six Hundred Dollars and Zero Cents ($16,600.00), pursuant to N.J.S.A. 40A:12-13 (b)(1); and

 

                     WHEREAS, the City has negotiated an Agreement of Sale (annexed hereto as Exhibit “A”) with NJDOT governing the terms of the conveyance of the portion of the lot and easements; and

 

 WHEREAS, the portion and easements to be conveyed are described as Parcel 105A (570 square feet), Easement Parcels E105B, E105C, E105D and UER105E (2,790 square feet total) on the map annexed to the Agreement entitled “Parcels105A, E105B, E105C, E105D and UER105E” (the Properties”); and

 

WHEREAS, NJDOT has provided an appraisal dated June 13, 2017, and annexed hereto as Exhibit “B”, performed by Raymond Underhill, which calculates the value of the Sale and Easement Property to be $16,600.00; and

 

WHEREAS, pursuant to Local Lands and Buildings Law, N.J.S.A. 40A: 12-13 (b)(1), the City of Newark is authorized to convey property that is not needed for municipal purposes to any department of the State of New Jersey without public bidding; and

 

WHEREAS, the City of Newark has determined that the Properties are no longer needed for public use.

 

                     NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

                     SECTION 1. The City hereby authorizes that the properties identified as Block 5001.01, Lot 3 also known as the former bed of the Morris Canal described as Parcel 105A (570 square feet), Easement Parcels E105B, E105C, E105D, UER105E (2,790 square feet total) on the map annexed to the Agreement entitled “Parcels105A, E105B, E105C, E105D and UER105E” be sold to the State of New Jersey Department of Transportation, a public body corporate and politic, for the completion of the Pulaski Skyway rehabilitation project by private sale for the appraised value of Sixteen Thousand, Six Hundred Dollars and Zero Cents ($16,600.00), pursuant to N.J.S.A. 40A:12-13 (b) (1).

 

                     SECTION 2. The Acting Director of the Department of Economic and Housing Development is hereby authorized to enter into and execute the Agreement of Sale, in the form attached hereto, any and all other documents which may be necessary in order to effectuate the sale of the Properties all in forms subject to the approval of the City of Newark’s Acting Corporation Counsel.

 

SECTION 3.  The Acting Director of the Department of Economic and Housing Development is hereby authorized to execute a Quitclaim Deed to the Redeveloper for the Properties. Said Quitclaim Deed conveying title to the Properties to the Redeveloper shall be approved as to form and legality by the City’s Acting Corporation Counsel and attested to and acknowledged by the City Clerk in forms subject to the approval of the City of Newark’s Acting Corporation Counsel.

 

                     SECTION 4. The Director of Finance is hereby authorized to place the consideration of $16,600.00 in the Redevelopment Trust Fund.

 

                     SECTION 5. That the copies of the executed Agreement of Sale shall be placed on file in the Office of the City Clerk by the Acting Director of the Department of Economic and Housing Development.

 

                     SECTION 6. This Ordinance shall take effect upon publication and final passage and publication in accordance with the laws of the State of New Jersey.

 

STATEMENT

 

Passage of this Ordinance will permit the City of Newark to convey title to land not needed for a public use to the New Jersey Department of Transportation for the completion of the Pulaski Skyway rehabilitation project by private sale for the appraised value of Sixteen Thousand, Six Hundred Dollars and Zero Cents ($16,600.00).
