WHEREAS, the City of Newark, Department of Engineering has proposed to improve pedestrian and bicycle connections along Center Street and Park Place between Broad Street and McCarter Highway (Route 21); and

WHEREAS, federal funding in the amount of $4,700,00.00 (Four million, seven hundred thousand dollars and no cents) has been provided in the Transportation Improvement Program (TIP) for the design and construction of the Newark Riverfront Pedestrian and Bicycle Access Project, with no City funds required; and

WHEREAS, the Director of the Department of Engineering desires to apply and accept the grant award; and

WHEREAS, the Director of the Department of Engineering shall submit a copy of the grant agreement to the Corporation Counsel and the Business Administrator for review, approval, and signature.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to apply to the New Jersey Department of Transportation (NJDOT) to request grant funding in the amount of $4,700,000.00 (Four million, seven hundred thousand dollars and no cents) for the Newark Riverfront Pedestrian and Bicycle Access Project, with no City funds required.

2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.

3. The grant award in the amount of $4,700,000.00 (Four million, seven hundred thousand dollars and no cents) from the New Jersey Department of Transportation (NJDOT) is hereby accepted.

4. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the New Jersey Department of Transportation (NJDOT) to receive and expend the grant award in the amount of $4,700,000.00 (Four million, seven hundred thousand dollars and no cents) for the Newark Riverfront Pedestrian and Bicycle Access Project.

5. No municipal funds are required for receipt or acceptance of this grant award.

6. The Director of Department of Engineering shall file a fully-executed copy of the grant application, the grant award letter and the grant agreement in the Office of the City Clerk.

STATEMENT

This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to apply and accept grant funds in the amount of $4,700,000.00 (Four million, seven hundred thousand dollars and no cents) from the New Jersey Department of Transportation (NJDOT) for the Newark Riverfront Pedestrian and Bicycle Access Project. No municipal funds are required for receipt or acceptance of this grant award.
