WHEREAS, Cooper’s Liquors & Deli, Inc., (hereinafter “Cooper’s Liquors & Deli, Inc.,”) located at 594 Orange Street, Newark, New Jersey 07103, wishes to provide food to the City of Newark’s Department of Health and Community Wellness; and
WHEREAS, Cooper’s Liquors & Deli, Inc., a corporate entity, wishes to donate to the City of Newark (the “City”), Department of Health and Community Wellness (“DHCW”), approximately Fifty (50) sandwiches valued at Eight Dollars and Zero Cents ($8.00) per sandwich; and
WHEREAS, pursuant to Local Public Contracts Law N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies, and gifts made to it and is empowered to utilize such bequests, legacies, and gifts in the manner set forth in the conditions of the bequest, legacy, and gift provided, however, that such bequest, legacy, or gift shall not be put to any use, which is inconsistent with the laws of the State of New Jersey and the United States of America; and
WHEREAS, Cooper’s Liquors & Deli, Inc., is donating Four Hundred Dollars and Zero Cents ($400.00) worth of sandwiches to feed the children attending Give a Kid a Smile Day, at no cost to the City (see Gift Letter attached hereto); and
WHEREAS, Cooper’s Liquors & Deli, Inc., fully understands and agrees it is not entitled to receive any direct benefit from the City in exchange for its gift; and
WHEREAS, pursuant to N.J.S.A. 40A: 5-29, the DCHW desires to accept the gift of $400.00.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council authorizes the Director of the Department of Health and Community Wellness, on behalf of the City of Newark, to accept the gift from Cooper’s Liquors & Deli, Inc., located at 594 Orange Street, Newark, New Jersey 07103, of approximately 50 sandwiches valued at Eight Dollars and Zero Cents ($8.00) per sandwich for the total value of Four Hundred Dollars and Zero Cents ($400.00), to provide food for the children during Give a Kid a Smile Day at the Department of Health and Community Wellness.
2. No municipal funds shall be expended for the acceptance of this gift.
3. The Director of Health and Community Wellness shall file a copy of the gift letter in the Office of the City Clerk.
4. The acceptance of the gift is ratified from on or about February 20, 2026, to the date of adoption of this authorizing Resolution.
STATEMENT
This Resolution ratifies and authorizes the Director of the Department of Health and Community Wellness, on behalf of the City of Newark, to accept the gift of Fifty (50) sandwiches valued at Four Hundred Dollars and Zero Cents ($400.00) to feed the children during Give a Kid a Smile Day from Cooper’s Liquors & Deli, Inc., 594 Orange Street, Newark, New Jersey 07103. This gift is at no cost to the City of Newark.
