WHEREAS, the Newark Police Department needs to install its RMS Modems previously purchased as part of the COPS Interoperability grant in twenty-five (25) police vehicles to facilitate the efficient submission of reports and to allow officers to utilize the National Crime Information Center (NCIC) while remaining on patrol; and
WHEREAS, the Newark Police Foundation, located at 744 Broad Street, Newark, NJ 07102, wishes to donate to the Newark Police Department the services of Triangle Communications, LLC ("Triangle") 57 River Road, Berkeley Heights, New Jersey 07922, to provide the antennas, cabling, configuration and installation of the twenty-five (25) RMS Modems; and
WHEREAS, the estimated value of this gift is Ten Thousand Three Hundred dollars ($10,300.00); and
WHEREAS, the Newark Police Foundation fully understands and agrees that it is not entitled to receive any direct benefit from the City of Newark in exchange for its gift (letter attached); and
WHEREAS, the Mayor and or his designee, the Business Administrator and/or the Police Director desire to accept the gift from the Newark Police Foundation; and
WHEREAS, pursuant to Local Public Contracts Law ( N.J.S.A. 40A:5-29) a local unit is authorized and empowered to accept bequests, legacies, and gifts made to it and is empowered to utilize such bequests, legacies, and gifts in the manner set forth in the conditions of the bequest, legacy and gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of America; and
WHEREAS, it is in the best interests of the City of Newark to accept this gift.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor, Business Administrator and/or the Director of the Newark Police Department are hereby authorized pursuant to N.J.S.A 40A:5-29 to accept a gift from the Newark Police Foundation with an estimated value of Ten Thousand Three Hundred dollars ($10,300.00) for the services of Triangle Communications LLC, to provide the antennas, cabling, configuration and installation of the RMS modems in twenty-five (25) police vehicles to facilitate the efficient submission of reports and to allow officers to utilize NCIC while remaining on patrol.
2. The acceptance of the gift is ratified from February 1, 2011 to the date of adoption.
3. No municipal funds shall be expended for the acceptance of this gift.
4. The Newark Police Foundation expects nothing in return as a result of this gift to the Newark Police Department.
STATEMENT
This resolution authorizes the Mayor, Business Administrator and/or the Director of the Newark Police Department to accept a gift from the Newark Police Foundation of services from Triangle Communications, LLC to provide the antennas, cabling, configuration and installation of the twenty-five (25) RMS modems which services have a total estimated value of Ten Thousand Three Hundred dollars ($10,300.00), to facilitate the efficient submission of reports and to allow officers to utilize NCIC while remaining on patrol.
