WHEREAS, on May 24, 2016, the City of Newark, through its Supervising Procurement Specialist, advertised to solicit bids for contractor(s) to provide Hospital and Surgical Equipment, Instruments and Supplies to the City of Newark’s Department of Health and Community Wellness, as per the bid proposal attached hereto and made a part hereof; and
WHEREAS, the Division of Central Purchasing distributed seven (7) bid proposal packages to the prospective vendors following the date of advertisement; and
WHEREAS, on June 9, 2016, the Division of Central Purchasing received two (2) bids in response to this advertisement; and
WHEREAS, the Director of the Department of Health and Community Wellness, reviewed and evaluated the two (2) bids received, and recommends that a dual award of contracts for the provision of Hospital and Surgical Equipment, Instruments and Supplies to the City of Newark, to the following vendors: Cen-Med Enterprises, Inc., 121 Jersey Avenue, New Brunswick, New Jersey 08901, and Munro Surgical Supply, Inc., 4 Rumson Court Pennington, New Jersey 08534, the only responsive and responsible bidders (copies of the Award Recommendations and the Bid Results are attached hereto and made a part hereof); and
WHEREAS, the Supervising Procurement Specialist also reviewed and evaluated the two (2) bids received, and concurs with the recommendations of the Director of the Department of Health and Community Wellness, that for the provision of Hospital and Surgical Equipment, Instruments and Supplies to the City of Newark, the two (2) vendors identified in the preceding paragraph be awarded the contracts as they were the only responsive and responsible bidders; and
WHEREAS, pursuant to N.J.S.A. 40A:11-24, the responsive and responsible bidders consented to hold prices until such time as an award is made; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1, et seq., meets the requirements of the fair and open process.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Supervising Procurement Specialist, are hereby authorized to enter into and execute contracts with Cen-Med Enterprises, Inc., 121 Jersey Avenue, New Brunswick, New Jersey 08901, and Munro Surgical Supply, Inc., 4 Rumson Court Pennington, New Jersey 08534, whose bids were received on the advertised due date and who were determined to be the responsive and responsible bidders for the categories identified on the price schedules in accordance with the bid specifications, to purchase Hospital and Surgical Equipment, Instruments and Supplies, as more specifically identified in the paragraph immediately below, for the City of Newark’s Department of Health and Community Wellness. The term of the contracts will be established for two (2) year terms, pursuant to N.J.S.A. 40A:11-3. The cost of these contracts shall not exceed a combined total of Forty Thousand Dollars and Zero Cents ($40,000.00) for both vendors, for the entire two (2) year term.
2. Cen-Med Enterprises, Inc., is awarded: 1st year line item numbers 1, 2, 3, 4, 7, 8, 11, 21, 22, 28, 29, 30, 32, 33, 34, 35, 38, 39, 40, 42, 43, 44 and 50; and 2nd year line item numbers 1, 2, 3, 4, 7, 8, 9, 10, 11, 13, 15, 21, 22, 28, 29, 30, 31, 32, 33, 34, 35, 38, 39, 40, 42, 43, 44, 45, 49 and 50. Munro Surgical Supply, Inc., is awarded: 1st year line item numbers 5, 6, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 23, 24, 25, 26, 27, 31, 36, 37, 41, 45, 46, 47, 48, 49 and 51; and 2nd year line item numbers 5, 6, 12, 14, 16, 17, 18, 19, 20, 23, 24, 25, 26, 27, 36, 37, 41, 46, 47, 48 and 51.
3. There shall be no amendments or changes to these contracts without the approval of the Municipal Council by resolution.
4. There shall be no advance payment on these contracts in accordance with N.J.S.A. 40A:5-16. Pursuant to N.J.A.C. 5:30-5.5(d), funds for 2016 and subsequent years are contingent upon appropriations.
5. These are open-ended contracts to be used as needed during the terms of contracts. Thus, for any and all expenditures against these contracts, a certification of the availability of sufficient funds, as required by N.J.A.C. 5:30-5.5(b)(2), shall be executed before a contractual liability is incurred each time an order is placed from account line(s) NW011, 120, 1202, 83240, B2016- Medical Care Services, covering the amount of the order.
6. D The Supervising Procurement Specialist shall file duly executed copies of these contracts in the Office of the City Clerk .
7. If required by State Law, the City Clerk shall provide the appropriate notice of the award of these contracts, to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This Resolution authorizes the Mayor and/or his designee, the Supervising Procurement Specialist, to enter into and execute contracts with two vendors: Cen-Med Enterprises, Inc., 121 Jersey Avenue, New Brunswick, New Jersey 08901, and Munro Surgical Supply, Inc., 4 Rumson Court Pennington, New Jersey 08534, for two (2) year terms for the purchase of Hospital and Surgical Equipment, Instruments and Supplies, as specified by line item numbers, for the City of Newark’s Department of Health and Community Wellness, at a cost not to exceed a total of Forty Thousand Dollars and Zero Cents ($40,000.00) for the two (2) vendors, for the entire two (2) year periods.
