                     WHEREAS, the City of Newark (the “City”) is a municipal corporation organized and existing under the laws of the State of New Jersey and located in Essex County; and

 

                     WHEREAS, on April 17, 2013, the Newark Municipal Council (“Municipal Council”), pursuant to N.J.S.A. 40:56-65 et seq., adopted Ordinance 6PSF-B (“Creating Ordinance”), establishing a Special Improvement District (“SID”)known as BLC Special Improvement District,   consisting of the properties designated and listed on Schedule A, annexed hereto by tax block and lot numbers and street addresses, and designated BLCSID Partnership, Inc. as the  District Management Corporation; and

 

                     

                     WHEREAS, BLCSID Partnership, Inc., the Mayor of the City of Newark (“Mayor”), and the Municipal Council wish to amend the Creating Ordinance to  remove the Class 2 Residential Properties included in the SID and referenced in Schedule A, and thus replacing the current Schedule A with the attached Schedule B, which is attached hereto and made a part hereof and will be the new Schedule A; and

 

WHEREAS, BLCSID Partnership, Inc., the Mayor, and the Municipal Council find it in the best interest of the City of Newark to authorize the Tax Collector to withhold, from each quarterly payment to BLCSID Partnership, Inc., an Administrative Fee of 1% of the Special Assessment actually collected by   the Tax Collector.

 

NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY THAT:

Section 1.

§ 10:32-4.2 FINDINGS.

Pursuant to the Act, the Governing Body of the City of Newark hereby determines the following:

 

a.  That the creation of the BLC Special Improvement District, as identified by the tax Block and Lot numbers and street address as set forth in Schedule “A” to this Ordinance 6PSF-b, April 17, 2013, and amended by this Ordinance, will benefit the properties included within the District., which specifically excludes the following properties:

 

1.                     Class 2 Residential Property, which consists of residential structures of four units or less.

 

 

SECTION 2.

 

§ 10:32-4.4 LICENSE FEE ASSESSMENTS.

 

e.  The City Tax Collector shall withhold from each quarterly payment to the District Management Corporation, an Administrative Fee of one (1%) percent of the special assessment actually collected by the Tax Collector according to the adopted budget.

 

SECTION 3.

 

All City ordinances or parts thereof inconsistent herewith are hereby repealed to the extent of their inconsistency only.

 

SECTION 4.

 

If any part of this Ordinance shall be declared to be invalid or inoperative, such part shall be deemed severable and the invalidity thereof shall not affect remaining parts of this Ordinance.

 

SECTION 5.

 

This Ordinance shall take effect upon final passage and publication in the accordance with the laws of the State of New Jersey.

 

SECTION 6.

 

This Ordinance shall be a part of the Code of the City of Newark as though codified and fully set forth therein.  The City Clerk shall have this Ordinance codified and incorporated in the official copies of the Code.  The City Clerk and the Corporation Counsel are authorized and directed to change any Chapter, Article and/or Section number of the Code of the City of Newark in the event that the codification of this Ordinance reveals that there is a conflict between the numbers and the existing Code, and in order to avoid confusion and possible accidental repealers of existing provisions not intended to be repealed.

 

STATEMENT

 

This Ordinance amends Title X, Finance and Taxation, Chapter 32, Special Improvement Districts, Subchapter 4, BLC Special Improvement District (“BLCSID”), of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, by amending the properties included in the BLCSID to remove the Class 2 Residential Properties and to authorize a 1% Administrative Fee withheld from each quarterly payment.
