ORDINANCE AMENDING TITLE X, FINANCE AND TAXATION OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED BY ADDING A NEW SECTION CHAPTER 34, PROHIBITION ON USE OF CITY FUNDS FOR FOSSIL FUEL INCLUDING FOSSIL FUEL POWER GENERATION.

WHEREAS, the Newark Municipal Council adopted Title X, Finance and Taxation; and;
WHEREAS, the City wishes to amend Title X by adding Section 34: Prohibition on Use of City Funds for Fossil Fuel including Fossil Fuel Power Generation;
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

Section 1. Title X, Finance and Taxation, Chapter 34, Prohibition on Use of City Funds for Fossil Fuel including Fossil Fuel Power Generation, is hereby amended and supplemented to read as follows
10:34-1. DEFINITIONS.
a. Fossil Fuel Facilities shall mean facilities used for the production, processing, refining, storage, or transfer of fossil fuels that are designated as, or located on, a “major source of air pollution” by the New Jersey Department of Environmental Protection (NJDEP).
These include:
◦ Petroleum Refineries, All Other Petroleum and Coal Products Manufacturing, Refined Petroleum Pipelines
◦ Petroleum Bilk Stations and Terminals, Petroleum and Petroleum Products Wholesalers
◦ Fuel Oil Dealers, Fuel Dealers
◦ Natural Gas Pipeline, Distribution, and Transmission
◦ Oil and Gas Pipeline and Related Structures
◦ Fossil Fuel Electric Power Generation
b. Fossil Fuel Power Generation Facilities shall mean facilities which convert fossil fuels into electric energy or steam.
c. City shall mean the City of Newark or other office, position, administration, department, division, bureau, board of commission, or a corporation, institution or agency of City government, the expenses of which are paid in whole or in part from the Director of Finance.
2. Prohibition on City Funding of Fossil Fuel Facilities, including Fossil Fuel Power Generation
a. The City shall not invest any public fund in, or otherwise expend any public funds to support, any new or expanded fossil fuel facilities, including fossil fuel power generation facilities. The City shall not directly or indirectly provide financial investment, subsidies, grants, tax incentives, bond financing, contracts, or in-kind support for the development, expansion, or extension of such facilities within the City. Any existing budgeting or capital improvement authorizations in conflict with this section are hereby nullified, and no City officer of entity shall approve or enter into any agreement that violates this prohibition.
STATEMENT
This ordinance amends and supplements Title X, Finance and Taxation, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, by adding a new Section Chapter 34, Prohibition on Use of City Funds for Fossil Fuel including Fossil Fuel Power Generation.
