WHEREAS, Public Service Electric & Gas ("PSE&G"), in furtherance of its corporate commitment to the communities which it serves, does, from time-to-time, make certain grant funds available to support projects that it deems to be in alignment with its focus areas; and
 
WHEREAS, one of PSE&G's focus areas is "Sustainable Neighborhoods," which seeks to support programs that help to build safe, healthy and sustainable communities by supporting community centers to help strengthen family units; and
 
WHEREAS, PSE&G utilizes the services of community development intermediaries, including the Greater Newark Local Initiative Support Corporation ("LISC"), in order to help identify appropriate community projects in need of financial assistance, and also to manage and oversee any such community projects that may be undertaken; and
 
WHEREAS, the City of Newark's Boylan Street Recreation Center, located at 916 South Orange Avenue, is in need of substantial renovation, as more specifically described in the project description attached hereto and made a part hereof (the "Renovation Project"); and
 
WHEREAS, LISC has identified the Renovation Project as being appropriate for full funding through PSE&G's Sustainable Neighborhoods grant funds program; and
 
WHEREAS, PSE&G has agreed to fully fund the Renovation Project, through a grant to be administered by LISC, for a total amount not to exceed $100,000.00, i.e., $99,300.00 dollars for the renovation work itself, with the remaining $700.00 for the purchase of tee-shirts and supplies for a ribbon-cutting event to celebrate completion of the Renovation Project (the grant award letter from LISC is attached hereto and made a part hereof); and
 
WHEREAS, the contractor for the Renovation Project shall be selected through a fair and open public bidding process, and the contract award shall be subject to, and shall be the subject of, a separate authorizing resolution; and
 
WHEREAS, in the event that the open public bidding process makes it apparent that the Renovation Project, as currently envisioned, cannot be achieved at a cost not greater than $99,300.00, then in that case the Director of the City's Department of Neighborhood and Recreational Services will scale-back the Renovation Project as needed to lower the cost of construction to not more than $99,300.00; and
 
WHEREAS, the renovation of the Boylan Street Recreation Center would be of great benefit to the City of Newark and its residents; and
 
WHEREAS, the Director of the City's Department of Neighborhood and Recreational Services recommends that the $100,000.00 in grant funds be accepted from PSE&G/LISC for the Renovation Project; and
 
WHEREAS, no expenditure of City funds, or commitment of City resources, shall be required for the City to accept and utilize the grant funds in question; and
 
WHEREAS, the acceptance of the $100,000.00 in grant funds from PSE&G/LISC has been approved by the State Monitor in accordance with the Memorandum of Understanding between the City of Newark and the State (a copy of the State's waiver is attached hereto and made a part hereof).
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Director of the Department of Neighborhood and Recreational Services, are hereby authorized to enter into and execute documents with PSE&G/LISC as may be needed to receive grant funding in the amount for $100,000.00 for the renovation of the Boylan Street Recreation Center for the period commencing on September 1, 2014, and terminating on August 31, 2015.
 
2.      The grant award in the amount of $100,000.00 from PSE&G/LISC is hereby accepted.
 
3.      No City funds, or commitment of City resources, are required for receipt or acceptance of the grant award.
 
4.      In the event that it becomes apparent that the Renovation Project, as currently envisioned, cannot be achieved at a cost not greater than $99,300.00, then in that case the Director of the City's Department of Neighborhood and Recreational Services shall scale-back the Renovation Project as needed to lower the cost of construction to not more than $99,300.00.
 
5.      The Director of the Department of Neighborhood and Recreational Services shall file copies of the fully-executed grant award letter and grant agreement, if applicable, in the Office of the City Clerk.
 
STATEMENT
 
      This resolution authorizes the Mayor and/or his designee, the Director of the Department of Neighborhood and Recreational Services, to enter into and execute documents with PSE&G/LISC as may be needed to receive grant funding in the amount of $100,000.00 for the renovation of the Boylan Street Recreation Center, and this resolution further authorizes the acceptance of the grant funds.  No City funds or commitment of City resources are required
