WHEREAS, on July 14, 2021 through Resolution 7R2-b(S), the Municipal Council authorized the Mayor of the City of Newark to accept the following Workforce Innovation Opportunity Act (WIOA) allotments: WIOA - Youth ($2,291,471.00), WIOA - Adult ($2,157,397.00), WIOA - Dislocated Worker ($760,501.00); totaling $5,209,396.00 through the Newark Workforce Development Board (NWDB) grant funds for Program Year 2021 (July 1, 2021 through June 30, 2022) with eighty percent (80%) obligated by June 30, 2022 and fully expended by June 30, 2023; and

 

WHEREAS, there exists a need for NewarkWORKS to enter into a contract with an entity that can provide WIOA-Adult clients high school equivalency training pursuant to the provisions of WIOA Program Year 2021; and

 

WHEREAS, on March 8, 2021 NewarkWORKS advertised a Request for Proposal (RFP), returnable on May 21, 2021 for training services under the provisions of WIOA Program Year 2021; and

 

WHEREAS, on May 21, 2021, NewarkWORKS received a total of twelve (12) proposals for both WIOA Youth and Adult, which were opened on the same day and entered on a tabulation bid sheet, a copy of which is attached; and

 

WHEREAS, the Proposal received from American Institute of Professional Studies, was reviewed by a selection committee and approved by NWDB and was found to be advantageous to the City of Newark based upon price, experience and all other criteria listed in the RFP; and

 

WHEREAS, NewarkWORKS wishes to enter into a contract with American Institute of Professional Studies to provide high school equivalency pursuant to the WIOA for one hundred and fifty (150) WIOA-Adult clients for an amount not to exceed Five Hundred Twenty-Five Thousand Dollars and Zero Cents ($525,000.00) for Program Year 2021; and

 

WHEREAS, the Municipal Council wishes to authorize and ratify the use of competitive contracting for processing WIOA programs from July 1, 2021 to the date of adoption of this Resolution and authorizes the use in the future; and

 

WHEREAS, this contract is for library and educational goods and services which is exempt from the requirement of public biding, pursuant to State and Local Public Contracts Law, N.J.S.A. 40A:11-5(1)(q); and

 

WHEREAS, this contract is being awarded pursuant to the Fair and Open Procedures of the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5; and

 

WHEREAS,  the Municipal Council adopted the Contractor Pay-to-Play Reform Ordinance, R.O. 2:4-22C, which forbids the award of a contract to a Business Entity, as defined therein, which has made or solicited political contributions to Newark Municipal Candidates, office holders having ultimate responsibility for the award of a contract; candidate committees of the aforementioned candidates; and political or political party committees of the City of Newark or County of Essex; and continuing political committees or political action committees regularly engaged in the support of the City of Newark Municipal or County of Essex elections; and certain other political party or candidate committees, in excess of certain thresholds.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark, Deputy Mayor for Workforce Development and Director of Newark One Stop Career Center/NewarkWORKS are authorized to enter into and execute a contract with American Institute of Professional Studies, 24 Commerce Street, Suite #302, Newark, New Jersey 07102, to provide high school equivalency training to one hundred and fifty (150) WIOA-Adult clients for Program Year 2021.  The contract shall be established during the period commencing on July 1, 2021 and terminating on June 30, 2022 for an amount not to exceed Five Hundred Twenty-Five Thousand Dollars and Zero Cents ($525,000.00).  The term of the contract will be established for one (1) year.

 

2.                     This contract between the City of Newark and American Institute of Professional Studies is hereby ratified from July 1, 2021 to the date of adoption of the authorizing Resolution.

 

3.                     The contract is subject to availability of funds from the United States Department of Labor, Employment and Training Administration, Workforce Innovation and Opportunity Act of 2014 through the New Jersey Department of Labor and Workforce Development, with eighty percent (80%) obligated by June 20, 2022 and fully expended by June 30, 2023 or retuned to the State.

 

4.                     Attached hereto is Certification of Funds from the Director of the Department of Finance, which states: (1) that there are sufficient funds, in the amount of Five Hundred Twenty-Five Thousand Dollars and Zero Cents ($525,000.00), for purpose set forth here in above; and (2) that the line appropriation of the Official Budget which shall be charged is Business Unit NW051, Dept. G21, Div./Proj. M21E0, Account # 72060, Budget Ref: B2021.

 

5.                     There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.

 

6.                     There shall be no amendment or changes to this contract without approval of the Municipal Council.

 

7.                     The Director of NewarkWORKS shall file forth with a copy of the fully executed contract with the Office of the City Clerk and shall be made available for public inspection.

 

8.                     This contract is being awarded to a non-profit organization and as such is not governed by the State-Pay-to-Play Law, N.J.S.A. 19:44A-20-5.

 

 

STATEMENT
