WHEREAS, the Department of Engineering is in need of professional services to prepare the Design Documents, Bid Documents and handle Construction Management for the renovation of the new Newark Drop-in and Resource Center at 1136 Raymond Boulevard Newark, New Jersey 07102; and
WHEREAS, professional services, exempt from the requirement of public bidding, in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-5(1)(a)(i); and
WHEREAS, on May 10, 2024, the Department of Engineering issued a Request for Proposals (“RFP”) for professional engineering services related to the design, preparation of bid documents and construction management services for the renovation of the new Newark Drop-in and Resource Center at 1136 Raymond Boulevard Newark, New Jersey07102; and
WHEREAS, the City of Newark received a total of two (2) proposals in response to its request; and
WHEREAS, Design Resources Group Architects, AIA, Inc., 270 Davidson Avenue, Suite 303, Somerset, New Jersey 08873, submitted a proposal and it was found, based upon price and other factors, to be in the best interest of the City of Newark to accept their proposal; and
WHEREAS, the City of Newark wishes to enter into a contract with Design Resources Group Architects, AIA, Inc., to provide design services to prepare the Design Documents, Bid Documents and handle Construction Management for the renovation of the new Newark Drop-in and Resource Center at 1136 Raymond Boulevard Newark, NJ 07102, in an amount not to exceed Two Hundred Thirty-Nine Thousand Dollars and Zero Cents ($239,000.00); and
WHEREAS, the Local Public Contracts Law (N.J.S.A. 40A: 11-1 et seq.) requires that Notice of the Award of contracts for “Professional Services” without public bidding must be published in a local newspaper; and
WHEREAS, this contract is for an amount over $17,500.00 and is being awarded as a Fair and Open Contract pursuant to N.J.S.A. 19:44A-20.5; and
WHEREAS, the Municipal Council adopted City of Newark Municipal Code § 2:4-22C.1, which adopted the State of New Jersey's Pay-to-Play statutory requirements pursuant to N.J.S.A. 19:44A-20.5, as may be amended and supplemented, governing eligibility for municipal contracts.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized and directed on behalf of the City of Newark to enter into and execute a Professional Services Contract with Design Resources Group Architects, AIA, Inc., 270 Davidson Avenue, Suite 303, Somerset, New Jersey 08873, to prepare the Design Documents, Bid Documents and handle Construction Management for the renovation of the new Newark Drop-in and Resource Center at 1136 Raymond Boulevard Newark, New Jersey 07102, in an amount not to exceed Two Hundred Thirty-Nine Thousand Dollars and Zero Cents ($239,000.00).
2. The term of this contract shall be for a period of one (1) year from the date of a written to Notice to Proceed issued by the Acting Director of the Department of Engineering and/or his designee or until completion of construction.
3. This contract is being awarded pursuant to the Fair and Open Procedures of the State Pay-to-Play Law N.J.S.A. 19:44A-20.5, and pursuant to the provisions of the Local Public Contracts Law N.J.S.A. 40A:11-5(1)(a)(i), and is in compliance with the City of Newark Municipal Code § 2:4-22C.1, which adopted the State of New Jersey's Pay-to-Play statutory requirements pursuant to N.J.S.A. 19:44A-20.5, as may be amended and supplemented, governing eligibility for municipal contracts.
4. Attached hereto is the Comptroller’s Certification, which states: (1) that there are available sufficient legally appropriated funds in the amount of Two Hundred Thirty-Nine Thousand Dollars and Zero Cents ($239,000.00), for the purposes set forth.
5. There shall be no amendments or changes to this contract without prior approval of the Municipal Council and there shall be no advance payments made against this contract in accordance with N.J.S.A. 40A:5-16.
6. A copy of the executed agreement herein authorized shall be filed in the Office of the City Clerk by the Acting Director of the Department of Engineering and shall be made available for public inspection.
7. A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within ten (10) days of the adoption of this Resolution.
