WHEREAS, the City of Newark (“City”), through its Summer Youth Employment Program (“SYEP”), seeks to provide Newark youth with meaningful educational, career exploration, workforce readiness, and professional development opportunities; and
WHEREAS, Berkeley College, located at 536 Broad Street, Newark, New Jersey 07102, has submitted a proposal to host up to Two hundred (200) Newark youth participating in the Summer Youth Employment Program from July 13, 2026 through August 13, 2026 at a cost not to exceed Two Hundred Thousand Dollars and Zero Cents ($200,000.00); and
WHEREAS, Berkeley College will provide classroom space, computer laboratories, administrative offices, security personnel, faculty members, professional staff, guest speakers, and career-focused educational programming designed to expose youth to various industries and professions; and
WHEREAS, the program will operate Monday through Thursday from 9:00 a.m. through 1:00 p.m. utilizing six (6) instructional rooms consisting of classrooms and computer laboratories, multipurpose spaces, and administrative offices located at the Berkeley College Newark Campus; and
WHEREAS, Berkeley College will provide instruction and experiential learning opportunities in Graphic Design Studies, Justice Studies, Legal Studies, National Security, Entrepreneurship, Fashion and Marketing, Computer Applications, and Health Studies; and
WHEREAS, participants will engage in workforce readiness and career exploration activities including college readiness workshops, financial literacy training, soft skills development, career services workshops, vision board development, and educational tours; and
WHEREAS, participants will further benefit from presentations, demonstrations, and career panels featuring representatives from the United States Armed Forces, Newark Fire Department, Newark Police Division, United Airlines, real estate professionals, nutrition specialists, beauty industry professionals, culinary professionals, financial institutions, and other industry experts; and
WHEREAS, Berkeley College’s proposed services constitute educational services and programming that qualify as Library and Educational Goods and Services pursuant to N.J.S.A. 40A:11-5(1)(q); and
WHEREAS, Local Public Contracts Law N.J.S.A. 40A:11-1, et seq., requires a Resolution of the Governing Body authorizing the award of contracts for Library and Educational Goods and Services and further requires that the contract itself must be available for public inspection; and
WHEREAS, the QPA/Purchasing Agent and the Executive Director of Newark Workforce Development Board has determined that the educational services provided by Berkeley College are necessary to advance the goals of the Summer Youth Employment Program and provide Newark youth with valuable career awareness, educational enrichment, and workforce development opportunities; and
WHEREAS, the QPA/Purchasing Agent has determined and certified in writing that the value of this Contract will exceed Seventeen Thousand Five Hundred Dollars and Zero Cents ($17,500.00); and
WHEREAS, the Purchasing Agent has determined and certified in writing that the value of this contract will not exceed $200,000.00, Bus. Unit: NW 011, Dept. 010 , Div./Proj.: 0109, Acct: 72090 , Ref.: B2026, 2026 Budget and/or Grant Funding for the Summer Youth Employment Program (SYEP); and
WHEREAS, this contract is being awarded pursuant to a “Non-Fair and Open” process pursuant to State Pay-to-Play Law N.J.S.A.19:44A-20.5, and the Contractor Pay-to-Play Reform Ordinance 2:4-22C; and
WHEREAS, pursuant to N.J.A.C. 5:30-5.5 et seq. this contract is subject to the availability and appropriation of sufficient funds annually.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the QPA/Purchasing Agent and/or the Executive Director of Newark Workforce Development Board, are hereby authorized to enter into and execute a contract with Berkeley College, 536 Broad Street, Newark, New Jersey 07102, to provide educational and workforce development services for the Summer Youth Employment Program.
2. The term of the contract shall commence on July 13, 2026 and terminate on August 13, 2026.
3. The contract is awarded without competitive bidding as an exception to Local Public Contracts Law pursuant to N.J.S.A. 40A:11-5(1)(q), Library and Educational Goods and Services.
4. The total contract amount shall not exceed Two Hundred Thousand Dollars and Zero Cents ($200,000.00).
5. One Hundred Thousand Dollars and Zero Cents ($100,000.00) has been certified by the Chief Financial Officer as a partial certification of funds. Said funds shall be available for immediate expenditure and shall be distributed and utilized as needed during the term of the contract. Additional funds shall be certified and encumbered as they become available and are required for performance of this contract.
6. This contract is subject to the availability and appropriation of sufficient funds, pursuant to N.J.A.C. 5:30-5.5(d)(2).
7. The Determination of Value is attached and shall be filed with the Office of City Clerk.
8. Berkeley College shall provide educational instruction, career exploration activities, workforce development training, college readiness programming, financial literacy instruction, career services workshops, and related youth enrichment activities as outlined in its proposal.
9. Berkeley College shall maintain all required insurance coverage and comply with all applicable federal, state, and local laws and regulations.
10. Berkeley College has completed and submitted a Business Entity Disclosure Certificate, which shall be placed on file with the Resolution in the City Clerk’s Office, certifying that Berkeley College has not made any reportable contributions to a political or candidate committee in the City of Newark in the previous one year, and the Contract will prohibit Berkeley College from making reportable contributions through the term of contract.
11. This Contract was awarded pursuant to the non-fair and open procedures of the Pay-to-Play Law (N.J.S.A. 19:44A-20.5) and pursuant to the provisions of the Local Public Contracts Law to N.J.S.A. 40A:11-5(1)(q) and in compliance with Contractor Pay-to-Play Reform Ordinance 2:4-22C.1.
12. There shall be no amendments or changes to this contract without approval by the Municipal Council.
13. There shall be no advance payments on this contract in accordance with N.J.S.A. 40A:5-16.
14. An executed copy of the contract shall be filed with the Office of the City Clerk by the QPA/Purchasing Agent.
15. A notice of this action shall be published as required by law.

This Resolution authorizes the Mayor and/or his designee, the QPA/Purchasing Agent and/or the Executive Director of the Newark Workforce Development Board, to enter into and execute a contract with Berkeley College, 536 Broad Street, Newark, New Jersey 07102, to provide educational, career exploration, workforce development, and youth enrichment services for up to two hundred (200) Newark youth participating in the Summer Youth Employment Program from July 13, 2026 through August 13, 2026, for an amount not to exceed $200,000.00.
