This Resolution authorizes the City of Newark to enter into a Professional Services Contract #2023-01R PS with H2M Architects and Engineering, Inc. for the modernization of elevators at four (4) of public building sites, specifically,
920 Broad Street, 94 Williams Street, 110 Williams Street and 394 University Avenue.

WHEREAS, the City of Newark, Department of Engineering, is in need of Professional Services relating to the Modernization of Elevators at four of its sites, which include City Hall, 94 Williams Street, 394 University Avenue, and 110 Williams Street; and
WHEREAS, on April 14, 2023, the City publicly advertised a Request for Proposals (RFP), for the Modernization of Elevators at Multiple Sites Contract #2023-01R PS; and
WHEREAS, on May 11, 2023, three (3) firms, H2M Architects and Engineering, Inc., LAN, and NETTA Architects, submitted their responses to the RFP; and
WHEREAS, after carefully reviewing the three (3) proposals, a selection committee of personnel from the Department of Engineering unanimously selected H2M Architects and Engineering, Inc.,119 Cherry Hill Road, Suite 110, Parsippany, New Jersey 07054, for the Modernization of Elevators at Multiple Sites because its proposal was found to fulfill the requirements of the RFP, showed project understanding and meets all project team experience requirements; and
WHEREAS, the Acting Director of the Department of Engineering desires to accept the proposal submitted by H2M Architects and Engineering, Inc. located at 119 Cherry Hill Road, Suite 110, Parsippany, New Jersey 07054 for the Modernization of Elevators at Multiple Sites, in an amount not to exceed Two Hundred Sixty-Eight Thousand Fifty Dollars and Zero Cents ($268,050.00); and
WHEREAS, this contract is for an amount over $17,500.00 and is being awarded as a Fair and Open contract pursuant to N.J.S.A. 19:44A-20.5; and
WHEREAS, this award is in compliance with Ordinance 2:4-22C.1, which adopted the State of New Jersey’s Pay-to-Play statutory requirements, pursuant to N.J.S.A. 19:44A-20.5, as may be amended and supplemented, governing eligibility for municipal contracts.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are authorized on behalf of the City of Newark to accept the proposal from H2M Architects and Engineering, Inc., and execute Contract #2023-01R PS with H2M Architects and Engineering, Inc., 119 Cherry Hill Road, Suite 110, Parsippany, New Jersey 07054, for the Modernization of Elevators at Multiple Sites, in an amount not to exceed Two Hundred Sixty-Eight Thousand Fifty Dollars and Zero Cents ($268,050.00).
2. Attached hereto is a Certification of Funds issued by the City’s Chief Financial Officer, which states that there are available sufficient legally appropriated funds for the purpose set forth hereinabove. Funds for this contract in the amount of Two Hundred Sixty-Eight Thousand Fifty Dollars and Zero Cents ($268,050.00) is provided as below:

3. A copy of the Certification of Funds shall be filed in the Office of the City Clerk by the Acting Director of the Department of Engineering.
4. No changes to this contract are allowed without prior Municipal Council approval.
5. A fully executed copy of the contract shall be filed in the Office of the City Clerk by the Acting Director of the Department of Engineering and made available for public inspection.
6. This contract is to be completed within a period not to exceed 365 consecutive calendar days from the issuance of a formal Notice to Proceed by the Acting Director of the Department of Engineering. A copy of the Notice to Proceed shall be filed with the Office of the City Clerk.
7. This contract is being awarded pursuant to the Fair and Open Procedures of the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, and pursuant to the provisions of the Local Public Contracts Law, N.J.S.A. 40A:11-5(a)(i); and is in compliance with the City’s Pay-to-Play Reform Ordinance, R.O. 2:4-22C.
8. There shall be no advance payments made against this contract in accordance with N.J.S.A. 40A:5-16.
9. A Notice of this action shall be published in the newspaper authorized by law to publish legal advertisements and as required by law within ten (10) days of adoption of this Resolution.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, on behalf of the City of Newark, to accept the proposal submitted by H2M Architects and Engineering, Inc., located at 119 Cherry Hill Road, Suite 110, Parsippany, New Jersey 07054 for the for the Modernization of Elevators at Multiple Sites, in the amount not to exceed Two Hundred Sixty-Eight Thousand Fifty Dollars and Zero Cents ($268,050.00), to commence after the issuance of a formal Notice to Proceed for a contract period not to exceed 365 consecutive calendar days.
