WHEREAS, the City of Newark, Department of Recreation, Cultural Affairs and Senior Services, will operate the Diamond Gloves Boxing Semi-Finals Tournament for approximately Five Hundred (500) City of Newark residents, ages eight (8) and over, as a recreational and physical activity program; and
WHEREAS, the Diamond Gloves Boxing Semi-Finals Tournament will operate on September 15, 2017, from 2:00 p.m. to 12:00 a.m. and September 16, 2017, from 12:00 p.m. to 11:00 p.m.; and
WHEREAS, based upon the capacity and facility needs of the Diamond Gloves Boxing Semi-Finals Tournament, and the programs already scheduled to be conducted at the City of Newark’s recreational facilities, Newark Housing Authority’s The Waterfront gymnasium facility, 2 Grafton Avenue, Newark, New Jersey 07104, (“The Waterfront”) is required for the operation of the boxing tournament on September 15, 2017 and September 16, 2017; and
WHEREAS, this year, the City of Newark, Department of Recreation, Cultural Affairs and Senior Services, desires to operate the Diamond Gloves Boxing Semi-Finals Tournament at The Waterfront; and
WHEREAS, in order to operate the Diamond Gloves Boxing Semi-Finals Tournament at The Waterfront, the City of Newark is required to issue a Hold Harmless and Indemnification Agreement, agreeing to hold harmless, indemnify, and defend the Newark Housing Authority, its agents, servants and administrators from any and all liability arising out of or related to the use of said premises or property, including but not limited to, any and all costs, including attorney fees; and
WHEREAS, in order to operate the Diamond Gloves Boxing Semi-Finals Tournament at The Waterfront the City of Newark is required to obtain a permit to operate from the Newark Housing Authority; and
WHEREAS, the Newark Housing Authority is waiving the Permit Application fee for the City of Newark’s use of its facilities for the Diamond Gloves Boxing Semi-Finals Tournament; and
WHEREAS, the Municipal Council of the City of Newark supports the Diamond Gloves Boxing Semi-Finals Tournament by supporting its efforts to obtain a permit to use The Waterfront and have the City of Newark issue a Hold Harmless and Indemnification Agreement with the Newark Housing Authority.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council of the City of Newark supports the City of Newark’s Diamond Gloves Boxing Semi-Finals Tournament and authorizes the Director of the Department of Recreation, Cultural Affairs and Senior Services to obtain a permit to operate The Waterfront, 2 Grafton Avenue, Newark, New Jersey 07104, on September 15, 2017, from 2:00 p.m. to 12:00 a.m. and September 16, 2017, from 12:00 p.m. to 11:00 p.m.
2. The Director of the Department of Recreation, Cultural Affairs and Senior Services in furtherance of obtaining the above referenced permit for the stated purpose, is authorized to execute a Hold Harmless and Indemnification Agreement, as provided by the Insurance Fund Commission, providing for the indemnification of the Newark Housing Authority from any and all liability arising out of the use of The Waterfront, 2 Grafton Avenue, Newark, New Jersey 07104, on September 15, 2017, from 2:00 p.m. to 12:00 a.m. and September 16, 2017, from 12:00 p.m. to 11:00 p.m., for the City of Newark’s Diamond Gloves Boxing Semi-Finals Tournament.
3. The Director of the Department of Recreation, Cultural Affairs and Senior Services shall forward to the Newark Housing Authority’s, The Waterfront Center Manager, M. Reed, 2 Grafton Avenue, Newark, New Jersey 07104, copies of the Hold Harmless and Indemnification Agreement inuring to the benefit of Newark Housing Authority.
4. The Director of the Department of Recreation, Cultural Affairs and Senior Services shall file in the Office of the City Clerk, the duly executed copies of the Permit and the Hold Harmless and Indemnification Agreement inuring to the benefit of Newark Housing Authority.
STATEMENT
This Resolution authorizes the City of Newark to obtain a permit to use The Waterfront, 2 Grafton Avenue, Newark, New Jersey 07104, for the Diamond Gloves Boxing Semi-Finals Tournament on September 15, 2017, from 2:00 p.m. to 12:00 a.m. and September 16, 2017, from 12:00 p.m. to 11:00 p.m.; and to execute a Hold Harmless and Indemnification Agreement, as provided by the Insurance Fund Commission, providing for the indemnification of the Newark Housing Authority from any and all liability arising out of the use of The Waterfront for the Diamond Gloves Boxing Semi-Finals Tournament, for said dates and time.
