WHEREAS, on June 26, 2025, the City of Newark, through its Qualified Purchasing Agent, QPA, advertised to solicit proposals from qualified firms to provide Municipal Court Private Collection Agency Services, as described in the attached Request for Proposals (“RFP”) specifications package; and
WHEREAS, the Division of Central Purchasing published the RFP on the City of Newark’s electronic procurement portal to provide broader access and download capability to potential proposers; and
WHEREAS, via the electronic procurement portal, nineteen (19) RFP packages were downloaded by prospective proposers following the date of advertisement. On July 17, 2025, two (2) proposals were received in response; and
WHEREAS, pursuant to the RFP competitive process, a three (3) members evaluation committee was formed to review the proposals received and make an award recommendation, as outlined in the RFP specifications; and
WHEREAS, the Purchasing Agent obtained signed non-conflict letters from the members of the evaluation committee before releasing the RFP responses to the evaluators via the electronic procurement portal; and
WHEREAS, the Proposals Review Committee evaluated the responses from
Linebarger Goggan Blair & Sampson, LLP, 61 Broadway, Suite 2600, New York, NY 10006, and Ray Klein, Inc. DBA Professional Credit, 400 International Way, Springfield, OR 97477, in accordance with the evaluation criteria stated in the RFP; and
WHEREAS, after evaluation of the proposals, the Interim Municipal Court Administrator recommended that a single award be made to Linebarger Goggan Blair & Sampson, LLP, 61 Broadway, Suite 2600, New York, NY 10006, as the proposer determined to be the most advantageous to the City, price and other factors considered; and
WHEREAS, the Purchasing Agent concurs with the recommendation to award the contract to Linebarger Goggan Blair & Sampson, LLP, for the reasons stated; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitations conducted through public advertisement in accordance with N.J.S.A. 40A:11-1 et seq. satisfy the requirements of the Fair and Open Process; and
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Business Administrator and/or the Purchasing Agent, are hereby authorized to enter into a contract with Linebarger Goggan Blair & Sampson, LLP, 61 Broadway, Suite 2600, New York, NY 10006 for Municipal Court Private Collection Agency Services, at an amount not to exceed three hundred twenty-four thousand($324,000.00) dollars.
2. The contract term will be established for a period not to exceed twelve (12) consecutive months commencing upon execution, with the option to renew for a similar period, based on performance.
3. There shall be no amendment or change of this contract without the approval of the Municipal Council by resolution.
4. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16. Funds for 2026 and subsequent years are contingent upon appropriations, pursuant to N.J.A.C. 5:30-5.5(d).
5. This is an open-ended contract to be used as needed during its term(s). For any expenditures against this contract, a certification of the availability of sufficient funds, as required by N.J.A.C. 5:30-5.5(b)(2), shall be executed before a contractual liability is incurred each time an order is placed from the 2026 Budget of the Municipal Court.
6. The Qualified Purchasing Agent shall file a duly executed copy of the contract in the Office of the City Clerk.
7. If required by State law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated July 1, 2025.

This Resolution authorizes the Mayor and/or his designees, the Business Administrator and/or the Qualified Purchasing Agent to enter into a contract with Linebarger Goggan Blair & Sampson, LLP, 61 Broadway, Suite 2600, New York, NY 10006 to provide Municipal Court Private Collection Agency Services at an amount not to exceed three hundred twenty four thousand ($324,000.00) dollars, for a period not to exceed twelve (12) consecutive months upon a fully executed contract, with the option to renew for a similar period, based on performance.
