This resolution will authorize extension for an additional (90) days of Emergency Contract #E2025-06, issued for the period March 17, 2025 through June 17, 2025, awarded to Tire Waste Management 109 Meeker Avenue Newark, NJ 07114, in an amount not to exceed $80,000.00.

WHEREAS, on March 10, 2025, the Director of the Department Works (“Department”) requested a declaration of emergency for the immediate remove of used tires and rubbish from the service yard of the City of Newark to prevent potential health hazards associated with stagnant water accumulation, which could lead to a spread of the West Nile Virus, which is transmitted by mosquitoes breeding in standing water; and
WHEREAS, on March 17, 2025, pursuant to N.J.S.A. 40A:11-6 and N.J.A.C. 5:34-6.1(a), the Qualified Purchasing Agent, QPA, approved the aforementioned request and the Department entered into Emergency Contract # E2025-06 with Tire Waste Management 109 Meeker Avenue Newark, New Jersey 07114 for the period of March 17, 2025 through June 17, 2025 for total not to exceed emergency contract amount of Eighty Thousand Dollars and Zero Cents ($80,000.00); and
WHEREAS, the Department desires an additional extension of Emergency Contract # E2025-06 for the period commencing September 18, 2025 through December 17, 2025; and
WHEREAS, the existing conditions at the service yard located at 293 Oraton Street Newark NJ, if not addressed, present a danger to the residents of Newark; and
WHEREAS, City Ordinance 6PSF-e adopted on April 6, 2011, Article 2:5-13.2 (E)(1)(b)(c) limits the period of emergency contracts to ninety (90) days and extensions shall not be permitted without authorization of the Municipal Council.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Business Administrator, and/or Qualified Purchasing Agent, QPA, are authorized to execute an extension of Emergency Contract # E2025-06 with Tire Waste Management 109 Meeker Avenue Newark, New Jersey 07114 to continue to provide emergency tire removal at 293 Oraton Street Service Yard from September 18, 2025 through December 17, 2025.
2. The emergency contract extension is ratified from September 18, 2025 to the date of adoption of this authorizing resolution.
3. Funds are available under the Department of Public Works budget account code NW011-060-0605-71580-B2025 & NW011-065-0653-71580-B2024.
4. The City Purchasing Agent shall file a copy of Emergency Contract #E2025-06 with this Resolution in the Office of the City Clerk.
5. If required by State Law, the City Clerk shall provide the appropriate notice of the award of the contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10.
STATEMENT
This resolution ratifies and authorizes an extension of Emergency Contract # E2025-06 with Tire Waste Management 109 Meeker Avenue Newark, New Jersey 07114 from September 18, 2025 through December 17, 2025. The emergency extension does not increase the amount of the initial contract amount.
