TITLE
AN ORDINANCE DESIGNATING THE NEWARK COMMUNITY ECONOMIC DEVELOPMENT CORPORATION AS THE ZONE DEVELOPMENT CORPORATION FOR THE CITY OF NEWARK’S URBAN ENTERPRISE ZONE.

WHEREAS, pursuant to N.J.S.A. 52:27H-67, the governing body of a qualified Municipality, may by ordinance create or designate a nonprofit corporation to act as a zone development corporation for the municipality, and
WHEREAS, Chapter 2:2-80.1 of the Code of the City of Newark currently designates the Newark Economic Development Corporation as the zone development corporation for the City of Newark; and
WHEREAS, the Municipal Council desires to name the Newark Community Economic Development Corporation as the zone development corporation for the City of Newark’s Urban Enterprise Zone.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
Section 1. Title II Administration, Chapter 2, Office of the Mayor and Agencies, Part 2, Boards, Commissions and Agencies, Section 80, Zone Development Corporation ( Chapter 2:2-80) entitled “Zone Development Corporation” is hereby repealed and restated and replaced in its entirety with the following provisions:
2:2-80 Zone Development Corporation
2:2-80.1 Designation
The Newark Community Economic Development Corporation is hereby designated as the Zone Development Corporation for the City of Newark’s Urban Enterprise Zone as authorized by N.J.S.A. 52:27H-67.
2:2-80.2 Maintenance of Zone Development Plan
The Zone Development Corporation will assist the Department of Economic and Housing Development with the ongoing evaluation of the City’s zone development plan for its urban enterprise zone, including, from time to time, evaluating, assessing, maintaining and making recommendations for amendments to the City’s zone development plan.
2:2-80.3 Board of Directors of the Zone Development Corporation
The Zone Development Corporation shall at all times include on its board of directors representatives of the City of Newark, members of the business community of the City of Newark and representatives of community organizations in the City of Newark. The total membership of the board of directors for the Zone Development Corporation shall be broadly representative of businesses and communities within the City of Newark.
2:2-80.4 Powers of the Zone Development Corporation
The Zone Development Corporation shall be considered a local development corporation for the purpose of receiving any State financial or technical assistance as may be available for the City’s urban enterprise zone.
2:2-80.5 Responsibilities of the Zone Development Corporation
(a) It shall be the responsibility of the Zone Development Corporation to ensure that all provisions of the New Jersey Urban Enterprise Zones Act (N.J.S.A. 52:27H-60 et seq.) are adhered to in the administration of the urban enterprise zone for the duration of the urban enterprise zone designation.
(b) Pursuant to the requirements of N.J.S.A. 52:27H-67 the Zone Development Corporation shall develop and maintain either its own website or a webpage on the City of Newark’s website that provides increased public access to the Zone Development Corporation’s operations and activities. The following information shall be posted on the Zone Development Corporation’s website or webpage on the City of Newark:
(1) A description of the Zone Development Corporation’s mission and responsibilities;
(2) The budget of at least the three of the most recent consecutive fiscal years of the Zone Development Corporation;
(3) The most recent Comprehensive Annual Financial Report or other similar annual financial information of the Zone Development Corporation;
(4) The annual audit of at least the three most recent consecutive fiscal years of the Zone Development Corporation;
(5) The Zone Development Corporation’s bylaws, rules and regulations;
(6) The Zone Development Corporation’s official policy statements that are deemed relevant by the Zone Development Corporation’s board to the interests of the residents within the urban enterprise zone;
(7) Notices that comply with the “Senator Byron M. Baer Open Public Meetings Act,” N.J.S.A. 10:4-6 et seq., of meetings of the Board of Directors of the Zone Development Corporation which notices shall set forth the time, date, location, and agenda of the meeting;
(8) The minutes of each meeting of the Zone Development Corporation including all resolutions of the board and its committees for its current fiscal year as well as the approved minutes of meetings of the board for at least three consecutive fiscal years;
(9) The name, mailing address, e-mail address and phone number of every person who exercises day-to-day supervision or management over some or all of the operations of the Zone Development Corporation; and
(10) A list of attorneys, advisors, consultants, and any other person, firm, business, partnership, corporation, or other organization which received any remuneration of $17,500 or more during the preceding fiscal year for any service whatsoever rendered to the Zone Development Corporation.
Section 2. All Ordinances of the City of Newark which are inconsistent with the provisions of this Ordinance are hereby repealed as to the extent of such inconsistency.
Section 3. If any section, subsection, clause, or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by any Court of competent jurisdiction, such decision shall not affect the remaining portion of the Ordinance.
Section 4. This Ordinance shall take effect immediately upon final passage, approval and publication as provided by law.
STATEMENT
This ordinance designates the Newark Community Economic Development Corporation as the Zone Development Corporation for the City of Newark’s Urban Enterprise Zone. This ordinance also regulates the operations of the Zone Development Corporation.
