This Resolution modifies Resolution 7R3-a adopted on November 14, 2022 and authorizes the City of Newark to enter into Agreement Modification #1 to Agreement #2022-DT-BLA-209 with New Jersey Department of Transportation (NJDOT), to extend the contract term to October 1, 2025, at no additional cost.

WHEREAS, the Department of Engineering, Division of Traffic and Signals, has determined the Central Avenue Bridge Over NJ Transit City Subway is in need of rehabilitation and/or replacement; and
WHEREAS, on April 22, 2024, the City received a letter (a copy of the authorization letter is attached hereto and made a part hereof) from New Jersey Department of Transportation (NJDOT) authorizing an extension of Agreement #2022-DT-BLA-209 to complete the CR 508 Central Avenue Bridge Over City Subway Structure- Preliminary Design Project; and
WHEREAS, the City wishes to accept the extension of the contract term and enter into Agreement Modification No. 1 to 2022-DT-BLA-209 (a copy of the Agreement Modification is attached hereto and made a part of hereof), with the New Jersey Department of Transportation, Local Aid and Economic Development, extending from April 1, 2025 to October 1, 2025 for the CR 508 Central Avenue Bridge Over City Subway Structure - Preliminary Design project.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to accept from the New Jersey Department of Transportation (NJDOT) an extension of the contract term to Agreement #2022-DT-BLA-209, from April 1, 2025 to October 1, 2025, for the CR 508 Central Avenue Bridge Over City Subway Structure - Preliminary Design Project.
2. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering are hereby authorized on behalf of the City of Newark to enter into and execute Agreement Modification No. 1 to Agreement #2022-DT-BLA-209, and to accept the extension of contract term to October 1, 2025 for the CR 508 Central Avenue Bridge Over City Subway Structure between the City of Newark and New Jersey Department of Transportation.
3. The Acting Director of the Department of Engineering shall file a fully executed copy of the grant agreement in the office of the City Clerk.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to accept a time extension and enter into Agreement Modification No. 1 to Agreement #2022-DT-BLA-209 with the New Jersey Department of Transportation for the CR 508 Central Avenue Bridge Over City Subway Structure - Preliminary Design Project, which will extend the contract term until October 1, 2025. No Municipal funds are required for receipt or acceptance of this grant extension.
